EU launches investigations into TikTok: Violation of transparency and child

TikTok allegedly breached transparency and child protection obligations. The statement made by the European commissioner for the internal market, Thierry Breton, thus paves the way for investigations into the platform with the objective of having a safer internet for young people. This referring to the European law on digital services.

The investigation into the ByteDance-owned social network has focused on 'problematic design', 'time limits', the forced repeat effect, age verification and default privacy settings.

The formal procedure launched by the European Commission will assess whether TikTok may have violated the Digital Services Act - DSA in areas related to the protection of minors, transparency of advertising, access to data for researchers, as well as design risk management of their addictive and harmful content.

Based on the preliminary investigation conducted so far, also based on the analysis of the risk assessment report sent by TikTok in September 2023, as well as TikTok's responses to the commission's formal requests for information, the commission decided to initiate formal proceedings against TikTok according to DSA.

The process will focus on complying with obligations regarding the assessment and mitigation of systemic risks, in terms of actual or foreseeable negative effects resulting from the design of the TikTok system, including algorithmic systems, which may stimulate behavioral addictions. This assessment is necessary to oppose the possible risks for the exercise of the fundamental right to the physical and mental well-being of the person, for the respect of the rights of minors, as well as the influence on radicalization processes.

The mitigating measures in place will then be evaluated, particularly the age verification tools used by TikTok to prevent minors from accessing inappropriate content. Compliance with the obligations of the Law on Digital Services to implement appropriate and proportionate measures to guarantee a high level of privacy, security and protection for minors will then be assessed.
