The Competition Authority decided on Wednesday to fine the company Bankers Petroleum with a fine of approximately 19.9 million lek, for non-implementation of the previous decisions of the Competition Commission in 2020 and 2021.

During the review of the case by the Competition Commission, it was found that the company Bankers Petroleum Albania, which has a dominant position in the production of crude oil in the Republic of Albania, has not voluntarily implemented the obligation to apply equal trading conditions for the same commercial actions towards the companies with which it enters into contractual relations.

In addition, Bankers Petroleum Albania has not fulfilled the obligations given in relation to hydrocarbon operations during the year 2021 and the period January - July 2022, as well as for the costs and production of oil during the month of July 2022, since the data were deposited after the end of the monitoring procedure .

In the decision dated July 30, 2020, the Competition Authority decided to close the in-depth investigation procedure against Bankers Petroleum Albania in the crude oil production and trading market, but imposing some obligations on the company. Specifically, Bankers was required to apply equal trading conditions for the same commercial actions to the enterprises with which it enters into contractual relations, to supply crude oil processing enterprises in the domestic market, in compliance with contractual relations based on the provisions of the Civil Code.

Also, Bankers Petroleum Albania had to submit to the Competition Authority every quarterly report on oil costs, every quarterly report on oil production and hydrocarbon operations, as well as submit for preliminary assessment every draft contract that it would link with every refinery, for ensure compliance with the requirements of the law "On the protection of competition". Also, the CA recommended to Albpetrol and the National Agency of Natural Resources (AKBN) to carry out forecasts of the needs of the local market for the necessary supplies of crude oil and to supervise the supply plans of the local market by Bankers Petroleum Albania LTD.

The April 22, 2021 decision extended Bankers Petroleum's monitoring period until July 31, 2022.

The investigation of Bankers Petroleum in 2020 started after the complaint of the companies Tosk Energji and Al Global Oil, which respectively used the Refineries of Ballshit and Fieri, complaints which were mainly related to the non-supply of the required amount of crude oil from Bankers.

In fact, the only refinery in the country that processed crude oil for fuel production, that of Ballshit, after a long series of failures to return to normal long-term operation, was dismantled and sold for scrap, while the land where the facility is located is expected to used by the buyer for the construction of a photovoltaic park. At a time when fuel prices have reached record levels this year, Albania does not have a processing refinery to use the significant amounts of crude oil that is extracted in the country and that, in the vast majority, is exported./ Monitor
