Mayor Erion Veliaj's lawyers have asked the Constitutional Court to expedite the review of the lawsuit, in which they insist that the measure of arrest in prison against the official is unconstitutional.
The lawyers suggest that the Constitutional Court set a date on the calendar as soon as possible, linking this request to a series of arguments, including the damages resulting from the mayor's absence from office.
This lawsuit for acceleration comes two weeks after Veliaj, who has been arrested since February, sought the annulment of the lower courts' decisions that approved his detention. The Constitutional Court has not yet set a date, while earlier the same court ruled in favor of Veliaj, reinstating him and thus annulling the decision of the Council of Ministers.
Currently, the criminal case involving 30 defendants, including non-profit organizations, is stuck in a preliminary hearing. SPAK has articulated charges of corruption and money laundering, circulated according to the Special Prosecution Office after the abuse of funds and tenders.
The day before, the mayor, present at the trial, repeated his request to access the investigation files and for this he accused the judiciary of double standards, since the materials were made available to former President Meta and the other defendants.
On this point, both SPAK and Veliaj's defense adhere to the same Strasbourg decision, in the Khodorkovsky vs. Russia precedent, which mentions that the defendants can be given the materials on USB, an option offered by the prosecution, although in Albania the defendant was given the USB, but not the computer. Therefore, both sides adhere to the same decision, which they read according to the front they are on.
SPAK says that a USB is sufficient, while Veliaj suggests that, in the absence of a computer, the printed version be given. And citing the same decision used by the judiciary, Veliaj goes on to recall that Strasbourg, in this case, in the same decision, also considers the detention of the accused in a glass cage as a serious violation, so according to him, Strasbourg should be read to the end.
Who will withdraw remains to be seen from January 5th onwards, when the next session will be held.
