Sentenced to 4 years in prison, Special Appeal adds charges against former prosecutor Aurel Zarka: SPAK should investigate him for a structured criminal group

SPAK incorrectly classified the criminal offenses for the defendants in the "Toyota Yaris" case, including the former Vlora Chief Prosecutor Aurel Zarka, as the defendants acted as a structured criminal group.

This is the reasoning why a few weeks ago the Special Anti-Corruption Appeal overturned the First Instance decision that had sentenced Zarka to 2.8 years in prison in the application of summary judgment for exercising unlawful influence and corruption.

"In the five historical facts assessed as criminal, for which the defendant Mr. AZ was found guilty, three or more persons participated, who agreed and agreed to commit one or more criminal offenses, in order to realize material or other benefits of any kind," the Appeal emphasizes.

The First Instance decision was not appealed by SPAK as the Appeals Court ruled on Zarka's appeal, which in fact sought acquittal.

According to the Appeals Chamber, the evidence and circumstances clearly show that not only Zarka, but also the three other defendants in the case collaborated as a structured criminal group, contrary to the assessment of the prosecutors in the case, as well as the First Instance judges, who described it as simple collaboration in aggravating circumstances.

According to SPAK, the prosecutor and other individuals are accused of having exerted unlawful influence in eight criminal cases that were being investigated in four different prosecutors' offices and that are mainly related to organized crime activities such as money laundering or drug cultivation. One of the criminal cases, known as the "Toyota Auris", was registered after the seizure at the port of Durrës, in June 2018, of 3.4 million euros in 'cash' hidden in two used cars imported from Belgium.

In connection with the incident, Klevi Çani, Edi Lika and Alban Mollaymeri were initially arrested, while cousins ??Elvis Vladi and Alfred Vladi were charged. Six years later, in 2024, as a result of data obtained from the Sky ECC application, SPAK arrested Vlora prosecutor Aurel Zarka, lawyer Radovan Çela, Astrit Vladi – Elvis Vladi’s brother – and declared the investigator of the National Bureau of Investigation, Eriona Daupaj, wanted. This file will now be retried in the First Instance with a different trial panel, but it is not yet known whether SPAK will appeal through recourse to the Third Instance (Supreme Court).
