"They can't get more than Rama, Begaj and Peleshi" - SP proposes

Within the deadline set by the Constitutional Court and when the Parliament has officially started its recess, two socialist MPs, Aulona Bylykbashi and Admir Kadeli, have revised the salary formula for judges and prosecutors, proposing an increase of only 0.02%.

The amendments to the law were submitted on July 30 by the Socialist Party, which considers its obligation to the Constitution fulfilled. A higher increase, according to the proposing MPs, would create a deep gap in salaries at the hierarchical level, surpassing Niko Peleshi, Edi Rama or Bajram Begaj.

Regarding the coefficient 0.38, it has been determined as the result of a balanced assessment between the need to strengthen the material guarantees of the independence of magistrates and the obligation to respect the principles of proportionality, sustainability and coherence of the salary system in the public sector, since the simplest magistrate in the district courts is equal in salary to the Speaker of the Parliament and the Prime Minister, or in coefficient at the rate of 0.91 of the President's salary.

With this change from 0.36 to 0.38, the socialists argue that the effects of the previous method that left the salaries of justice system employees untouched, when salaries in the administration had a significant change, are being adjusted.

The report by Bylykbashi and Kadel explains that this level is considered sufficient to meet the objective of the draft law, without creating unjustified inequalities or disproportionate consequences for public finances.

The financial effect also includes arrears, which are calculated from 2023 and will be borne by the state budget divided into several budget years.

The Constitutional Court intervened in the heated debate between the majority and the association of judges and prosecutors, demanding a new scheme for their salaries.

For Prime Minister Edi Rama, the justice system must justify high-level payments with their work, while judges and prosecutors consider that financial guarantees are protection against political influences. (TCH)
