"We made a request to the court, we pointed out the mistake he made and he made two mistakes. The first mistake is that in the decision, in the enacting terms, they did not state that this decision he gave is final, or not? This is directly related to the execution, because if this decision is not final, it cannot be executed. The law provides, the code of procedure provides that it must be final. Under these conditions, the execution order issued is absolutely invalid and illegal.

He explains that, according to the criminal code, this is called an arbitrary order.

"The first, because it was not final and the second because the General Prosecutor's Office does not have jurisdiction and does not have the competence to be a participant in the Supreme Court for matters that belong to the Special Court and the Special Prosecutor's Office. If you look at the handicap or the paradox, in the decision it is stated that the applicant for recourse is the Prosecutor's Office at the First Instance Court for Serious Crimes in Tirana, that is, the Special Prosecutor's Office today, SPAK Jurisdiction at all. Since he is facing these two mistakes, we said that Dritan Dajti's sentence of 25 years ends and he is free. And he is released on the 5th .

According to the lawyers, this decision of the Supreme Court cannot extend its effects, given that there are also these ambiguities.

The court's decision cannot go beyond the law. If it is not final, that decision is not executed. But even if it will be final, it will be given after Dritan Dajti has served his sentence.
