Partizani Trial, former Minister Genc Ruli's testimony revealed

The court hearing on the "Partizani" case, where the defendant is former Prime Minister Sali Berisha, continued this Monday. In this session, former Minister of Economy, Genc Ruli, was questioned, who was asked about privatization procedures and the treatment of state properties.

Ruli stated that the Ministry of Economy represented the state as a civil owner and had competence for privatization procedures:

"The Ministry of Economy is a representative of the state, a civil owner. No contract related to state property can be signed except by the Ministry of Economy."

TESTIMONY

Ruli:  I was Minister of Economy in 2005. I have a role in supervising privatization processes. ME is the one that prepares the documentation. As politicians, we also obey a government program. The DP had taken the obligation that during the privatization processes, the interests of the former owners would be closely observed. We aimed to give the former owners a pre-emption right. In the "Partizani" case, it was a large property, known to the owners. They had been recognized as having the right of pre-emption. They were seeing that privatization was being carried out, but without taking into account the interests of the former owners. A representative of theirs came and met with me in 2006-2008, we made a series of changes to legal and sub-legal acts. I met with the former owners, but also with the owners of private entities.

The owner of the club at that time, Albert Xhani, I told him twice, I know that you have started the procedure with the previous government, but this will go in favor of the former owners. I even told him that even if you take them, the construction plots will end, just like many other sports grounds have ended. The urban hunger was great from the local government institutions. In the documents of the time, only the "Partisan Sports Club" was mentioned, only in name.

Ruli:  I found out what it was later, after I became interested after meetings with the former owners, or even from the private owner. In October 2005, I wrote a letter to the ministries asking them to bring us an inventory of the properties that we have as a state and also letters if there was interest from the owners to take over those properties. Mediu was among the first to respond, regarding the properties that were outside the expansion plan.

Ruli:  One of the things that hindered privatization was the multitude of instructions. I gave a response to Mediu after 7 months. I learned from the media today that the municipality had progressed in the meantime, had changed the destination.

Ruli:  Seeing the problems of privatization, cooperation between agencies, different actors, I have asked the government to appoint a responsible person in each ministry that had properties for privatization.

Spak:  The logic of privatization was for structures that had ceased their activity. What about the case of Partizani clubs?

Ruli:  I don't remember. We were not the head of the church in the privatization process. The verifications were done by the relevant ministries. We trusted the accompanying file. The Albanian state does not have its own properties registered even today. In the historical waters that we lived in ATP for 20 years, we had time to deal with this story!

Ruli:  The Ministry also gave a political signal to encourage the privatization process. Then the proposal had to come from the relevant ministries that owned the assets. After that, the Ministry of Economy reviewed the documentation brought by the ministries. Then we did a verification at the AMTP. Then we had an evaluation commission, which did the price evaluation.

Licensed accounting experts, one representative from the Ministry of Economy and one from the line ministry that had proposed privatization.

Spak: There was a change in the law on sports, which stated that sports facilities could not be privatized, but could be given through concession, provided that the purpose did not change.

Ruli:  It was done late. It should have been done in 1995.

SPAK: Since the privatization was approved in 2008, while the law prohibited the privatization of sports fields, referring to the law, could you do it?

Ruli: They didn't create an obstacle. It's just a complicating factor. In that case, we would give it to the former owners on a concession.

Ruli: Mr. Malltëzi did not come to meet me and ask me for favors regarding privatization.

Lawyer Gjyzari: Did you receive any directives from Mr. Berisha regarding this matter?

Ruli: No, I have not received any directives from Berisha regarding this issue.
