The assembly of presidents of the Chamber of Advocates of Greece has organized today a special conference on the "Beleri" case.

Greek lawyers stated that the human rights convention is being violated and that the measure is arbitrary. According to them, the measure aims to prevent the exercise of the mandate.

" He has no risk of escaping, but even if he exists it can be prevented. The second has no risk of falsification of evidence, since the investigation is over. There is only 1 witness speaking against him. There is no risk that he will commit another criminal offense.

The proportionality of this matter is the 4th element.

The prosecutor did not respond to these arguments, except to note that he was tried in August by the Court of First Instance, the Court of Appeal and the Supreme Court. I am surprised by a reasoned decision that is enough with the previous decision , "said the lawyers.

They further demanded that Beleri be transported to Himare to be sworn in as mayor.

" In this case when we have a detention, he avoids the obligation to exercise his duty and express the concerns of those who voted for him. The measure of detention is in violation of human rights. It contradicts the effectiveness of the electoral procedure. I don't get into the part about whether he is guilty or not. This is decided by the Albanian courts.

The sentence of 4 months, for us, is a disproportionate measure. I heard Prime Minister Edi Rama talk about the independence of the Judiciary, but I don't see that there is an independence report in this matter. In the judgment of June 26, 2023, SPAK does not have the jurisdiction to approve the permit requested by the person under investigation.
