The Hague Appeal announces today the verdict against the former heads of the KLA

The Court of Appeal in the Specialized Chambers in The Hague today pronounced the verdict for the appeal regarding the case against the former heads of the Organization of Veterans of the War of the Liberation Army of Kosovo (OVL-UÇK), Hysni Gucati and Nasim Haradinaj, who were found guilty in the first degree.

On May 18, 2022, Gucati and Haradinaj were found guilty of obstructing the administration of justice, being sentenced to four and a half years in prison.

Both have been in custody in The Hague since September 2020 and time spent in custody will count towards the sentence.

The lawyers of Gucat and Haradinaj immediately after the announcement of the judgment in the first instance appealed the decision, saying that they expect a reduction of the sentence.

They have argued that such a sentence "is manifestly excessive and beyond any sentence previously imposed in any other comparable case."

Haradinaj and Gucati were arrested on September 5, 2020 and have been in the detention center in The Hague since then. They were suspected of having distributed classified documents of the Specialized Chambers to journalists that same year, through several media conferences, at the OVL-UÇK headquarters in Pristina.

According to the Office of the Specialized Prosecutor, Gucati and Haradinaj had disclosed protected information, aiming to reveal hundreds of witnesses or potential witnesses of the Specialized Chambers, also known as the Special Court.

The Specialized Prosecution has argued that "justice has been served" with the sentencing of Gucat and Haradinaj.

"Intimidation or retaliation against these victims is, in my opinion, a very serious crime that strikes at the heart of this institution's ability to deliver justice and the rule of law," declared the then Specialized Prosecutor, Jack Smith.

These alleged crimes are mentioned in a 2011 Council of Europe report authored by then-Swiss senator Dick Marty.

The court is based in The Hague, but operates according to the laws of Kosovo./REL
