The clash between Socialist MP Plarent Ndreca and the Justice Inspectorate, headed by Artur Metani, deepens.
The clash that began about a year ago when Metani was reporting to the Assembly on the work of the ILD seems to have deepened now that the socialist MP says that this institution has not only been discredited but has failed and seriously undermines the foundations of the rule of law.
Earlier, Ndreca complained that the ILD had investigated only a little more than 10 cases out of over 3,000 complaints against magistrates. Today, he also attached his case to the letter, claiming that procedures were violated in the investigation conducted by SPAK against him.
Ndreca's full reaction:
Institutions that remain silent are the problem itself, not the solution.
Dear friends,
For more than a year (since May 2024 at the Laws Committee meeting) I have been involved in an institutional debate with the High Inspector of Justice, regarding his inaction towards serious constitutional violations by justice institutions - including a specific criminal investigation, as a symptom of a systemic problem that justice in general and criminal justice in particular have today.
After a long silence and after two letters sent by me to all national and international authorities dealing with justice, a written response has finally arrived from the ILD, which proves only one fact: the failure of this institution and with it, the failure of a constitutional instrument for the implementation of the principle of "checks and balances" between the powers. This failure has placed the judicial power in an uncontrolled, unbalanced and consequently irresponsible position, seriously violating the foundations of the rule of law.
Turning a blind eye to constitutional violations, to the serious detriment of fundamental human rights and freedoms – which lie at the foundation of the legal order according to Article 15/1 of the Constitution of the Republic of Albania and to the detriment of the rule of law – is not simply an institutional discrediting of the ILD, but an eminent danger to the balanced functioning of the state superstructure.
Today I publish my institutional reply, in which I reiterate my concerns as a member of the Assembly of the Republic of Albania and the limit set by the Constitution itself:
No one is above the law. Not the court, not the prosecutor's office, not the inspector, not the power of silence.
