The Constitutional Court has once again postponed the hearing on the operation for constructions without a permit with the Ministry of Interior.
This time the session has been postponed with the claim that the signatories who have signed this request must be present in the hall.
In a statement to the media, the democratic deputy, Gazment Bardhi, described this request of the Constitutional Court as absurd, as he further accused the troupe of trying to drag out the case by order of Prime Minister Edi Rama.
“Procrastination and procrastination. What I find is that the prime minister's blackmail has reached the Constitutional Court. A part of the members of the Constitutional Court received the mafia message from the Prime Minister", said Bardhi.
The opposition called the government's operation for the confiscation of constructions a violation of the law against DP and sent it to the Constitutional Court with the request to annul the decision since, according to the democrats, Rama has protected the oligarchs who built the Towers without permission in the middle of Tirana. Through the lawsuit, DP argued all violations of the law.
"It is contrary to the Constitution, because it violates the equality of citizens before the law, violates the hierarchy of normative acts and is not authorized by the law; - It is contrary to the Criminal Code, because it grants criminal amnesty to a category of persons, without a law approved by 3/5 of the votes in the Assembly; - It is contrary to the law on planning and development of the territory; "The government's decision stipulates that anyone who builds towers without a permit or additional floors without a permit must declare it, sell it to the state for 1 euro, then they can buy it and enjoy the illegal construction without worry.
This act is the illegal legalization of constructions without a permit, it is the criminal amnesty without the law, excluding them from prison sentences, it is a certification of inequality between citizens", - says the DP's lawsuit. The government law created numerous legal uncertainties for the confiscation of illegal constructions for the purpose of profit, which was approved at the beginning of last year. Many citizens, who have bought apartments in the 25 confiscated buildings, expressed concern about the future of their investment in these buildings. Jurists say that the decision of the Council of Ministers violates the right to property and legal security.
Building without permission is a criminal offense and investigative bodies have started investigations in at least 4 cases in Tirana. Although the authorities have stated that the Decision of the Council of Ministers on the confiscation of constructions without a permit for the purpose of profit does not save the builders who have exceeded the construction permit from criminal prosecution, there are still many legal ambiguities. The control of unauthorized constructions is carried out by several institutions such as the National Inspectorate for Territory Protection, the Inspectorates of Territory Protection in local units, the municipal and state police.
