The Socialist Party has come out with a strong warning to the media, regarding the application "Aktiv1sti" created by itself, where pressure is put on administration employees who are forced to "Like and Share" political statuses on social networks and it records points for how active they are.

SP has warned the media that whoever publishes the data contained within the application will be sued in court, as according to her, the information in question is nothing more than a product of a criminal offense, and seriously violates the right to privacy of the individual's private life.

"The Socialist Party of Albania will strictly follow this case and will proceed according to the law for further investigations in the Prosecutor's Office at the Judicial District Court of Tirana, for any media which will continue to publish these data in violation of the law even after this public demand." the notice says.

This reaction from the SP comes after the publication of some names, where part of that application were also many judges and prosecutors, or employees of some institutions that are considered independent. This application was created by SP on the eve of the May 14 local elections and claims that there is nothing illegal even though it is open pressure on the administration.

The Socialist Party of Albania is familiar with media reports about personal data of persons who are alleged to have downloaded and used the "Aktiv1st" platform. The Socialist Party has publicly denounced and announced the pursuit of legal avenues for the illegal intervention in its electronic infrastructure, specifically the "Aktiv1st" application and further the intentional manipulations of certain data obtained in violation of the law.

As has been made clear publicly, the "Aktiv1st" application is a communication tool of the Socialist Party which can be easily downloaded by any individual located in the Republic of Albania. The app is easily available on Playstore and Appstore for both Android and IOS mobile operating systems. Registration in the application as in any application requires some basic data that fits the typology of the application. The data filled in by the user, except for the first and last name, which are also his account in the application, are not displayed to other users. These data remain in the user's account, can only be seen by the registered individual and are not displayed in any other space. no one,

Partia Socialiste e Shqipërisë kërkon nga mediat audiovizive, mediat elektronike dhe të gjitha platformat e portalet online që të refuzojnë në çdo rast publikimin e të dhënave të pjesshme apo të plota qofshin ato, që pretendohet se janë siguruar nga ndërhyrja e kundraligjshme në paltformën elektronike “Aktiv1st”, pronë e P.S.SH si dhe të fshijnë cdo informacion nga përmbajtja e faqeve të tyre të internetit të publikuar deri tani. Sjellim në vëmëndjen tuaj se Kodi Penal i RSH (neni 186/a K.P, 192/b, 239/a, 293/b, 293/c)  ka kriminalizuar ndërhyrjet e paautorizuara kompjuterike, përgjimin e të dhënave kompjuterike, ndërhyrjet e paautorizuara në të dhënat kompjuterike etj, dhe çdo posedim i të dhënave të përfituara nga kryerja e veprave penale sjell pasoja sipas ligjit.

Gjithashtu, të dhënat e siguruara nga ndërhyrja e kundraligjshme nuk mund dhe nuk duhet të publikohen në asnjë rast nga ana e mediave pasi këto të fundit nuk kanë statusin ligjor për një veprim të tillë në bazë të parashikimeve të ligjit Nr. 9887, datë 10.3.2008 “Për mbrojtjen e të dhënave personale”, i ndryshuar. Neni 6 dhe 7 të ligjit 9887/2008 kërkon domosdoshmërisht marrjen e pëlqimit në mënyrë të qartë nga subjekti i të dhënave persoanle, në të kundërt publikimi i tyre bie automatikisht në paligjshmëri. Publikimi i të dhënave të përfituara nga kjo ndërhyrje vjen në kundërshtim edhe me ligjin Nr. 97/2013 “Për mediat audiovizive në Republikën e Shqipërisë” dhe Kodin Etik të medias shqiptare pasi informacioni në fjalë nuk është tjetër veçse një produkt i veprës penale, dhe cënon rëndë të drejtën e fshehtësisë së jetës private të individit. Partia Socialiste e Shqipërisë do të ndjekë në mënyrë rigoroze këtë rast dhe do të procedojë sipas ligjit për hetime të mëtejshme në Prokurorinë pranë Gjykatës së Rrethit Gjyqësor Tiranë, për çdo media e cila do të vazhdojë të kryejë publikimet e këtyre të dhënave në shkelje të ligjit edhe pas kësaj kërkese publike.
