Parliament 'locks' evidence against Belinda Balluku: Sign that you
Edi Rama/ Belinda Balluku

SPAK asked the Parliament on Tuesday to authorize this prosecution to take another preventive measure against Balluk, which is protected by the immunity of the deputy.

But the voluminous file submitted to the Assembly along with this request has not been distributed to the members of the Council, which has the legal authority to decide whether or not Balluk's immunity should be lifted.

According to opposition MPs who are members of this council, the office of the Speaker of the Assembly has only made available to them the summary report of the file after they signed a declaration not to disclose investigative secrets.

The Albanian Parliament released a response to the media justifying the Speaker of the Parliament's decision with the fact that the material containing the evidence against Balluk was 'investigative secret' and had been 'locked' in a safe in the Parliament premises until the council meeting on Friday where it will be decided how the MPs will be acquainted with the material.

"The material with a "secret investigative" character is located in the protocol specialist's safe for classified documentation," the Assembly announces.

The decision, according to the announcement, was made based on an order of the Special Prosecutor's Office "On the preservation of investigative secrecy and the prohibition of the publication of acts" and obliges the Assembly to preserve investigative secrecy and prohibit the publication or distribution of such acts.

According to the Assembly, " this issue and the manner of familiarizing yourself with this information will be discussed at the meeting of the Council for Regulation, Mandates and Immunity, in the presence of the SPAK prosecutor ."

The Assembly also calls on the deputies who have been informed of the summary material of the file to "strictly enforce the preservation of investigative secrecy, in accordance with the order of the prosecutor of the case."

But the chairman of the Democratic Party parliamentary group, Gazment Bardhi, in a public reaction described Pelesh's decision as wrong and contrary to parliamentary regulations and practices.

"I can no longer keep Edi Rama's corruption in a safe! It is out in the open, in every public matter!", he addressed the Speaker of Parliament in a reaction distributed in the media.

"SPAK, according to the law, has the obligation to bring the report to the Assembly, accompanied by supporting evidence. These are not brought to be locked in the Assembly Protocol vault, but to be made available to the members of the Mandates Council and the accused MP, so that they are prepared for decision-making at the meeting," Bardhi further says.

Article 118 of the Rules of Procedure of the Assembly provides in point 1 that "The Speaker shall immediately send the request and accompanying documents to the Council on Rules of Procedure, Immunity and Mandates for review and shall inform the deputy."

In previous parliamentary practice, even when files were considered 'investigative secret' by the prosecution, they were made available to council members after they signed a declaration that they were responsible for not revealing the investigative secret.

On Wednesday, DP leader Sali Berisha, during a media conference, publicly read several leaked conversations between Balluk and her subordinate Ervis Berberi about the tenders for the lots of the new Tirana Ring Road, similar to other conversations leaked to the media from investigations into other tenders, showing how these tenders are set in advance./ BIRN
