The Constitutional Court of Albania has released its decision on the case filed by former Prime Minister Sali Berisha, who requested the annulment of court decisions against him regarding the security measure "house arrest" imposed by the Special Court.

In its decision, the Court analyzed the constitutionality of the legal procedures followed by the authorities and rejected Berisha's request, confirming the legality of the investigations into corruption and money laundering.

Key points of the decision:

Constitutionality of the investigations – The court argued that the procedures followed by the Special Prosecution Office (SPAK) were in accordance with the Constitution and the defendant's procedural rights were not violated.

The principle of separation of powers – It was emphasized that the Constitutional Court cannot interfere with the decisions of other justice institutions, except in cases where there are direct constitutional violations.

Freedom of Action of the Prosecution – The Court confirmed that SPAK has the legal authority to investigate corruption cases at high levels of government and there is no evidence indicating unlawful interference in this process.

Respect for individual rights – It was analyzed whether Berisha had a fair legal process, concluding that there was no violation of the right to a fair trial.

The decision was initially issued on January 17 of this year.

Berisha gained his freedom on November 27 of last year, when the Special Court in the preliminary session decided to lift the security measure of "house arrest", but the Special Appeal on January 3 reinstated the measure of "compulsory appearance" against him.

In a session held on November 21, 2024, the Constitutional Court also rejected Berisha's request regarding the mandatory reporting measure, while declaring the ban on leaving the country disproportionate, returning the passport to the leader of the Democratic Party.
