The leader of the Republican Party, Fatmir Mediu, spoke today at a media conference regarding the judicial process against him in the Gerdec case , describing it as a political fabrication that, according to him, attempts to play with the tragedy.

Mediu stated that at the beginning of the incident, he had resigned as part of his moral responsibility and had surrendered his immunity to pave the way for judicial investigations.

According to him, the prosecution itself has conclusively proven that he was not involved in any act of corruption and for this reason he is not being tried for such an offense, but for abuse of office.

"The prosecution has accused me and I am not being tried for corruption, but for abuse of office. In the written evidence presented by SPAK itself to the court, it is clearly stated that there is no connection or transaction and benefit of Fatmir Mediu from the SAK company or the Albademil firm. Also, the court and the prosecution, on 6.04.2023, have made the decision in this process that the accusation against me has no connection with the explosion in Gërdec and its consequences," he stated.

According to Mediu, the charge of abuse of office for which he is being tried is related only to technical military issues, such as caliber classification, ammunition transportation, and security issues, and not to the functions of the Minister of Defense.

Media:  Following the criminal process that is taking place under my charge, I consider it necessary to clarify some essential elements for public opinion.

First, I want to clearly emphasize that I have never been accused of corruption and I have not been accused of being responsible for the victims or damage to people and property caused by the tragic explosion in Gërdec on March 15, 2008. This is a legal truth that results from the prosecution's own acts, both in the first investigations conducted by the General Prosecutor's Office, as well as in the accusation filed today by SPAK.

The only charge against me relates to the allegation of failure to fulfill or abuse of office. However, at no point in this process has it been specifically determined which legal duty I violated, or which law, decision of the Council of Ministers or other normative act that imposed a specific obligation on me I violated. None of the acts of the charge identify a specific legal duty that I violated or failed to fulfill.

On the contrary, even from the investigations themselves it results that the administrative and technical responsibilities for activities related to the process of dismantling the ammunition belonged to other structures of the Ministry of Defense and the General Staff, which had the relevant institutional competencies for this activity.

It is also important to note that the prosecution itself, yesterday and SPAK today, have never accused me of corruption nor as the cause or responsible for the victims and property damage caused by the Gërdec explosion.

The investigation against me has been complete and comprehensive. For almost 18 years, extensive verifications have been carried out in all directions, a complete "360-degree" investigation, which has essentially confirmed this very reality: that there is no evidence of corruption against me and no responsibility for the tragic consequences of the Gërdec explosion.

At the same time, I would like to emphasize that this process should not have been restarted and should not continue. The failure to consider the institution of the statute of limitations for criminal prosecution, both by SPAK and by the Special Court, constitutes a serious violation of the law and directly violates the fundamental principles of the rule of law, as well as fundamental human rights and freedoms. The statute of limitations is a legal guarantee established precisely to protect legal certainty and to prevent criminal prosecutions that are unlimited in time.

However, despite the fact that the process has been accompanied by serious procedural and material problems, I have respected and will continue to respect the institutions and

the development of the judicial process, believing that the legal truth will emerge in its entirety.

At this moment, I would also like to express once again my deep regret and pain for all the families and citizens who have suffered and continue to suffer the consequences of the Gërdec tragedy. It is a grave event for the entire Albanian society and its wounds are still open.

But it is equally important to state clearly that I am not the cause and I am not responsible for the victims and damages caused by that tragedy. The legal truth of this process cannot be built on political perceptions or interpretations, but only on the law and on evidence.

I remain convinced that justice, in the end, will decide based on the law and facts and not on the basis of opinions, political likes or dislikes, or imposed by pressures from various, non-legal interests.
