Through his lawyer, former Kosovo President Hashim Thaçi has expressed his gratitude for the support, as he described it, extraordinary that he, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi have received from the citizens of Kosovo and from international supporters.
He also appealed to citizens to remain calm following the conviction of the Kosovo Specialist Chambers in The Hague against former KLA leaders.
With a note in the "X", the lawyer of former Kosovo President Hashim Thaçi, Luka Misetic, stated that they will appeal the decision.
According to him, the defense claims that during the trial and in the first instance verdict, significant legal and factual errors were made, which, according to it, affected the fairness of the process.
Misetic said that throughout the process, the defense raised concerns about the way the trial was conducted, especially about the questions that the members of the Trial Panel asked directly to witnesses and parties.
According to the defense, these interventions were such that they created doubts about the impartiality of the trial panel.
"Hashim Thaçi wishes to express his sincere gratitude for the great support that he, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi have received from the people of Kosovo and the international community. He calls on the citizens of Kosovo to remain calm in their reaction to yesterday's injustice.
Mr. Thaçi's lawyers will appeal yesterday's verdict of the Trial Panel to the Appellate Panel of the Kosovo Specialist Chambers (KSCC), arguing that significant errors were made in the interpretation of the law and in the assessment of the facts, which undermined the fairness of the judicial process.
Throughout the trial, the Defense repeatedly raised concerns regarding respect for procedural rules and the right to a fair trial, including the broad scope of questions asked directly by members of the Trial Panel, in a manner that, according to the Defense, did not create the impression of impartiality.
The defense maintains that the judges' interventions exceeded the bounds of a neutral search for the truth, violating the perception of impartiality required by international standards of justice. According to it, this lack of impartiality is already reflected in the Trial Panel's verdict.
The defense argues that the findings of guilt beyond a reasonable doubt are based on insufficient evidence and unconfirmed by other evidence.
Moreover, yesterday, the Trial Panel publicly declared that Mr. Thaçi was involved in the murder of Behajdin Allaqi, after having previously ordered all parties in this case not to publicly discuss Mr. Allaqi's case during court hearings, and had ordered that all evidence related to this case be kept confidential.
According to the Defence, the Trial Chamber has publicly found Mr. Thaçi guilty of murder, while the evidence on which this conclusion was based has been kept hidden from public scrutiny. Mr. Thaçi would welcome such a public scrutiny of the evidence.
The defense will appeal the Trial Panel's decisions, arguing that they violated his fundamental rights to a fair trial, guaranteed by the European Convention on Human Rights and the Constitution of Kosovo.
Mr. Thaçi categorically denies any involvement in the murder.
"Adherence to rigorous standards of procedural fairness is essential to maintaining public confidence in international criminal justice institutions. The Defense will formally file a notice of appeal with the Appeals Panel, with the aim of correcting these factual, legal and procedural errors," the response states.
