The Hague Prosecutor's insistence that the KLA leaders not be released from detention has increased the harsh reaction of the defense.

In her latest submission, Jakup Krasniqi's lawyer mentions the sentencing of former KLA leaders. In this document, it is stated that the latest development also contradicts the presumption of innocence and undermines human rights.

"Jakup Krasniqi has already served four years and six months in detention. This prolonged deprivation of liberty weighs heavily against continued detention, especially given the fundamental right to be presumed innocent and the extraordinary length of time he has already served without conviction. Detention is the exception, not the rule, and should be a measure of last resort. Mr. Krasniqi's continued detention in these circumstances could be perceived as a preliminary punishment, which conflicts with the presumption of innocence and would undermine the very rights that form the foundation of a fair trial," Jakup Krasniqi's defense brief states.

The potential punishment and undermining of human rights has resulted from the refusal of temporary release.

According to the lawyer, detention is now completely unnecessary as the witnesses and evidence of the Hague Prosecution have been completed.

“The circumstances have now changed fundamentally. The Prosecution has called its last witness and the main justification for the continuation of detention – namely, the risk that Mr Krasniqi might interfere with Prosecution witnesses – no longer exists in any concrete or credible form. There are no other witnesses to influence. Any claim that Mr Krasniqi might obstruct the proceedings by interfering with witnesses who have already testified, or in any matter to be raised by the Victims’ Advocate, is entirely speculative, lacks any factual basis and is insufficient to justify his further deprivation of his liberty. Continued reliance on conjecture of this kind would be disproportionate and unjustifiable,” Jakup Krasniqi’s defence submission further states.

The defense also mentions Jakup Krasniqi's challenges in detention, including his advanced age.

“Mr. Krasniqi’s personal circumstances have evolved significantly and merit compassionate consideration. First, he is now 74 years old and [REDACTED] in the last four and a half years, [REDACTED]. 2 The Panel is aware of [REDACTED]. More recently, [REDACTED]. 4 [REDACTED] are not merely ancillary – they go to the heart of [REDACTED] to participate meaningfully in his defence, particularly in the context of prolonged detention. Since the beginning of his detention, two grandchildren have been born. Mr. Krasniqi now seeks to return to his family with dignity and spend meaningful time with his growing family – an incentive that only strengthens his motivation to comply with any conditions that the Panel may impose,” it further states.

Kadri Veseli's defense has insisted that the Hague Prosecution is aiming in every way to keep the accused in custody, and this constitutes a violation.

Jakup Krasniqi's defense has proposed 7 concrete measures that Krasniqi is willing to implement under house arrest, just to be released and stay close to his family.

Rexhep Selimi's defense also objected to the claims of the Hague Prosecution. According to the lawyers, the Prosecution has failed to prove that Rexhep Selimi could escape, or has the intention to influence evidence and witnesses.

All defense teams unanimously criticize the fact that despite the Prosecution's witnesses having finished and all evidence having been submitted, their clients are not being released.
