The Energy Regulatory Body has postponed to July 1, 2026 the deadline for the TAP gas pipeline to fulfill the condition imposed on it as part of the gas transmission licensing and which is related to the ownership titles. According to the decision of that time, the company had to submit to ERE "Not later than 01.07.2024, the complete documentation showing the ownership titles on the assets it has to perform the functions or fulfill the obligations under the license required in the territory of Albania, according to law no. 107/2021 "On co-governance".
In a letter dated July this year, the company informed the Entity that part of the process has been completed, but not completely.
"Within the fulfillment of this condition, with the letter recorded in ERE with no. 1683 prot., dated 26.07.2024, the company has informed that it has completed the process of registering the rights of the purchased land and the easement, both for the pipeline corridor of the gas pipeline and for the above-ground facilities (the compressor station, the measuring station and the stations of blocking valves).
The company also informs that in accordance with the provisions of law no. 116/2013 "On the ratification of the agreement with the government of the host country, between the Republic of Albania, acting through the Council of Ministers, and Trans Adriatic Pipeline AG regarding the Trans Adriatic Pipeline project (TAP project), and the agreement between the Republic of Albania , represented by the Council of Ministers, and Trans Adriatic Pipeline AG, in relation to the Trans Adriatic Pipeline project (TAP project)", and the legal framework for expropriation, these rights are registered on behalf of the Ministry of Infrastructure and Energy, including the rights on the state land secured through the Decision of the Council of Ministers" announced the Entity in its latest decision.
According to the company's submission referring to the provisions of the Agreement, ownership and easement rights, secured by the expropriation process, must be transferred in the name of TAP, in accordance with Appendix 1, Part 1, paragraphs (h) and (i) hereof agreement. This process is only possible through the Decision of the Council of Ministers and for this reason the company has submitted to ERE the official request dated 07.06.2024 addressed to the Ministry of Infrastructure and Energy, the Ministry of Finance and the State Cadastre Agency regarding this process, where it requested the cooperation of these institutions, as responsible but also specialized institutions in this field, in securing properties and consolidating property rights affected by the TAP gas pipeline. For the above, the company has informed that it is waiting for the answer related to this process.
Also, the company has clarified that the changes that have occurred in the procedures related to the cadastre, which are now carried out only through the e-Albania portal, have caused delays in the process of completing the registration of buildings and has emphasized that all these processes I am following them with the relevant institutions continuously.
"For all of the above, the company has asked ERE to postpone the deadline for fulfilling the condition set in point 2 of the decision of the ERE board no. 15/2019, amended, clarifying that the time needed to prepare and approve the government's decisions is a process outside the direct control of TAP, and for this reason it has sought the understanding of ERE to approve a postponement of second for a 24-month period, as in the previous decision" underlines the Entity in the decision to postpone the deadline.
