Online betting, Government approves new rules for suspension and revocation of licenses

The government has approved a new decision that determines the procedures and deadlines for the suspension or revocation of licenses of operators that carry out online sports betting activities in Albania.

According to the decision, administrative measures will be applied to entities that do not meet the basic licensing criteria, do not 'harden' the guarantee fund, repeat the violations provided for in the law, do not settle obligations to the Gaming Supervisory Authority (AMLF) or to the winners of the game, as well as in other cases determined by the legislation in force.

The decision stipulates that the procedures for suspension or revocation are initiated by the AMLF or the Licensing Commission, depending on the nature of the violation. After controls, inspections and review of documentation, the Licensing Commission may propose to the Minister responsible for Finance to take the appropriate measure, while the final decision is taken by a reasoned order from the Minister.

The new rules guarantee the right of operators to be notified, to participate in hearings and to present their explanations before a decision is made.

According to the act, the license may be suspended for a period of 30 days until the required conditions are met, but not more than two years. During the suspension period, the operator is not allowed to exercise the activity and must comply with all obligations set out in the Minister's order.

The decision also provides for the establishment of an AD-HOC committee within the Ministry of Finance to review proposed practices for license suspension or revocation, while the AMLF will monitor the implementation of orders and compliance with conditions by operators.

Operators affected by these measures retain the right to appeal the decision to the competent court, according to the legislation in force. The decision enters into force 15 days after publication in the Official Gazette.
