The letter that the Special Prosecution Office addressed to the Albanian Parliament to authorize the arrest or deprivation of liberty of Belinda Balluku, MP, minister and deputy prime minister at the same time, has been revealed.
The letter sent to the Speaker of Parliament, Niko Peleshi, and the members of Parliament, bears the signature of the acting head of the Special Prosecution Office, Altin Dumani.
The latter, on December 19, the very day that the Council for Regulation, Mandates and Immunity will meet to review the request, will hand over the mandate of the head of SPAK, Klodian Brahos, who was elected on December 11 as its new head.
What does the letter to the Assembly say?

In it, Dumani requests authorization for the arrest/deprivation of the liberty of MP/Minister/Deputy Prime Minister Belinda Balluku, through the replacement of the personal security measure from that of "Prohibition of leaving the country" and "Suspension of exercising a public duty or service", to that of prison/house arrest.
Dumani also requests that investigative secrecy be maintained and that the publication of documents be prohibited.
The letter signed by Dumani cites Articles 73, 95 and 103 of the Constitution, as well as Articles 260, 288 and 289 of the Code of Criminal Procedure, as well as Articles 13 and 118 of the Rules of Procedure of the Assembly.

The Council on Rules of Procedure, Mandates and Immunity will meet on December 19 to review the request. Once Belinda Balluku is officially notified, she has the right to provide explanations, be represented by a lawyer and fully exercise her right to defense.
The Council reviews the request and within 2 weeks drafts a report, recommending its approval or rejection. The report is distributed to the deputies. The request is then included as the first item on the agenda of the plenary session.
According to the Rules of Procedure of the Assembly, the floor is given to the MP for whom the request was made, without opening a discussion on the report. The decision is made by open vote.
If the Assembly does not express its opinion within 3 months, the request of the Special Anti-Corruption Prosecutor's Office is considered rejected.
