The Supreme Court has given the green light to the extradition to Germany of an Israeli citizen arrested in Tirana in February 2025.

42-year-old Roy Garin, with Israeli and Canadian citizenship, also known by the names Michael Finkle, Mike and Jean Meringac, is wanted by German justice as the leader of a group of cyber fraudsters.

According to the arrest warrant issued against him by the Bamberg Court, in Germany, in the period 2015-2022 this group is suspected of having defrauded nearly 288 citizens through investments, causing them a damage of almost 26 million euros.

After the Tirana Court and the Court of Appeal rejected the claims for non-extradition, the Supreme Court recently rejected the appeal made by the 42-year-old, thus paving the way for his extradition to Germany.

In all three levels of the judiciary, Garin claimed that if extradited, he would risk inhuman and discriminatory treatment in Germany because of his Jewish origin. Through his lawyer, Garin referred to the RIAS 2024 report, which documented 8,600 anti-Semitic incidents for the first half of the year and an increase in attacks on people with Jewish identity.

The courts of three instances have reasoned that anti-Semitism constituted a form of hatred and discrimination against Jews, but is not related to the positions of the German government or judiciary.

According to the reasoning of the First Instance and Appeal Courts, assessed as correct by the Supreme Court, there are no reports or decisions of international courts that evidence violations by the German authorities in this regard.

Regarding the RIAS report, the courts considered that it constituted only a monitoring instrument and not evidence of systematic violations of human rights.
