Strasbourg punishes again. Albanian courts violated human rights

Another decision of the European Court of Human Rights penalizes Albania, pointing out that the justice system is weak in terms of basic human rights.

Strasbourg decided this week with a majority of votes that Albania has violated the right of access to justice, receiving justice in a reasonable period of time and serious violations of private law.

The court considered the application of an Albanian citizen who, after exhausting all levels of justice in the country, did not find justice in relation to the violence inflicted on his son in 2011 by another minor. Due to the violence, his son lost the sight in one eye.

The claimant alleged that the school did not take all necessary measures to prevent his son from being harmed, seeking damages. In 2013, the Tirana Judicial District Court rejected the request for compensation, on the grounds that the damage was caused by a third party and not by the school.

The applicant then filed two appeals in the Court of Appeal of Tirana and in the Supreme Court, both of which were rejected. The Supreme Court decided that it could not intervene in the decision of the Court of Appeal because it did not find material and procedural violations in the application of the law.

The case ended up in the Constitutional Court, but the latter rejected it on the grounds that it was filed outside the time limits. The Strasbourg Court notes in its decision that the assessment of the Albanian courts, at all levels, is misleading and in serious violation of Articles 8 and 6 of the European Convention on Human Rights.
