Part of a structured criminal group, GJKKO sentences Nehat Kulla's nephew

The Special Court sentenced Akil Kulla to 13 years in prison as part of a structured criminal group and for possession and production of explosive weapons.

The nephew of Nehat Kulla benefited from the shortened trial and was ultimately sentenced to 8.8 years in prison.

GJKKO has decided that Akil Kulla will serve his sentence in a high security prison.

Announcement of GJKKO:

1. The Special Prosecutor's Office against Corruption and Organized Crime on 30.01.2024 submitted to the Court the request with the object: Judgment of the criminal case against the defendant Akil Kulla, accused of committing the criminal offenses: "Unauthorized possession and production of of weapons, explosive weapons and ammunition" for the provision, storage, modification and adjustment with the purpose of selling for profit weapons and their parts and finding them in large quantities in the premises owned by him and the defendant Sokol Xhura, according to paragraphs 6, 7 and 8 of article 278 of the Criminal Code, carried out in cooperation in the form of "Structured criminal group" with the co-defendant Enver Jamaku and the defendant Sokol Xhura, provided by articles 278/6, 278/7 278/ 8, 28/4, 333/a/2 and 334/1 of the Criminal Code; -The production, possession, purchase or sale of cold weapons without a permit", provided by article 279/1 of the Criminal Code, for carrying two knives, which meet the conditions of cold weapons, cutting with wire.

2. At the end of the judicial review, the Special Court of First Instance for Corruption and Organized Crime, and with a panel composed of judges Atalanta Zeqiraj, Flora Hajredinaj and Rudina Palloj, with decision No. 36 dated 12.06.2024, decided:

1. The guilty declaration of the defendant Akil Kulla related to the criminal offense "Possessing without permission and the production of weapons, explosive weapons and ammunition" committed in the special form of cooperation that of the structured criminal group, provided by article 278/6 in connection with articles 28/4, 334 point 1 of the Criminal Code, and his sentence of 10 (ten) years of imprisonment.

2. The guilty declaration of the defendant Akil Kulla related to the criminal offense "Possessing without permission and the production of weapons, explosive weapons and ammunition" provided by article 278/7 of the Criminal Code, carried out in the special form of cooperation that of the structured group criminal, in relation to articles 28/4, 334 point 1 of the Criminal Code, and his sentence of 12 (twelve) years of imprisonment.

3. The guilty plea of ​​the defendant Akil Kulla related to the criminal offense "Unauthorized possession and production of weapons, explosive weapons and ammunition", carried out in the special form of cooperation of a structured criminal group, provided for by Article 278/8, in connection with articles 28/4, 334 point 1 of the Criminal Code, and his sentence of 6 (six) years of imprisonment.

4. The guilty declaration of the defendant Akil Kulla regarding the criminal offense "Structured criminal group" provided by Article 333/a/2 of the Criminal Code, and his sentence of 2 (two) years of imprisonment.

5. The guilty plea of ​​the defendant Akil Kulla related to the criminal offense "Production, possession, purchase or sale of cold weapons without permission" provided by article 279/1 of the Criminal Code and his sentence of 6 (six) months of imprisonment.

6. In application of Article 55 of the Criminal Code, the punishments are combined into one, the defendant Akil Kulla being sentenced to 13 (thirteen) years of imprisonment.

7. In application of Article 406 point 1 of the Penal Code, 1/3 of the sentence is reduced, finally sentencing the defendant Akil Kulla to 8 (eight) years and 8 (eight) months of imprisonment.

8. Referring to Law No. 81/2020 On the Rights and Treatment of Prisoners and Detainees", the sentence for the defendant Akil Kulla begins from the day of execution of the decision and will be carried out in a high security prison .

9. The expenses during the preliminary investigation phase and those of the trial carried out regarding the defendant Akil Kulla are charged to him.

10. Against this decision, an appeal can be made to the Special Court of Appeal for Corruption and Organized Crime, within 15 (fifteen) days, from the day after learning about the reasoned decision. Tirana, on 12.06.2024
