The allegations of the General Prosecutor's Office regarding the manner of drafting and the content of the new Criminal Code have raised suspicions of fictitiousness in the drafting process and consultations of the working group regarding this draft.

This institution insists that it was not officially represented in the working group.

Sources from the General Prosecutor's Office told Top News that at one point a representative from the General Prosecutor's Office was requested to participate in a phase of discussions on a general part of the draft completed by the working group and then in mid-2023, this general part of the draft code was sent to prosecutors for consultation, but there was no concrete follow-up.

Regarding the correspondence with former prosecutor Kujtim Luli, who was removed from office in October 2023, the General Prosecutor's Office says that Luli was involved simply to give his opinion and that he was not part of the close working group that drafted the draft.

According to sources from the working group drafting the new criminal code, Kujtim Luli has sent his proposals regarding the content of articles 34 to 39 of the law.

The same sources state that Luli's presence refutes the General Prosecutor's Office's claims that he was not involved in drafting the code.

The draft has faced criticism from the General Prosecutor's Office, which has considered it repressive, from the Chamber of Advocates, which has called it inquisitorial, and from media associations that consider it a step backward in guaranteeing freedom of expression.
