The Constitutional Court announced this Wednesday, April 15, the decision that partially accepted the judges' request for an increase in their salaries.

The Constitutional Court of Albania ruled on February 17 that judges' salaries cannot be reduced, but left it to the Assembly to make legal changes.

While today it has published the full arguments for this decision, made with a 7-1 consensus, where the only one who requested the rejection of the judges' request was Gent Ibrahimi. The Assembly will have to approve the legal changes by July of this year.

"The Court considers that it is up to the Assembly to adopt the necessary legal amendments, according to the reasoning of this decision, to avoid the hidden reduction and to adjust the salary of magistrates in a fair ratio to other increases and the duty and function, which must be achieved by 31.07.2026. The Assembly may choose to adapt the new formula in order to repair the hidden reduction either by referring to the change that the category of civil servants to which the old formula referred or to the change that the President's salary underwent, or any other solution comparable to the changes and categories above and within their limits, always respecting the guarantees of Article 138 of the Constitution, bearing in mind the fact that inflation and the economic situation have the same effect on all categories of employees, regardless of the duty and function they perform.", states the Constitutional Court's decision.

We recall that the debate on the issue was "ignited" especially after two judges' associations demanded a salary increase. Prime Minister Edi Rama reacted sharply, saying that their salaries are higher than those of judges in Greece and twice as much as those in the region. The head of government even said with conviction that the salaries of judges and prosecutors will not increase as long as he is prime minister.

On the other hand, judges demanded that their salaries be automatically indexed whenever salaries in other state sectors increase, considering this as a constitutional guarantee of judicial independence.

Rama's statements have been responded to by emphasizing that they are "being publicly lynched." The head of the executive's stance also prompted a reaction from the National Association of Judges of the Republic of Albania, which spoke of a deliberate campaign of public and political pressure on a process that is currently under review in the Constitutional Court.
