The Tirana Prosecution Office requested the Tirana Court of First Instance of General Jurisdiction to discontinue the investigation against the head of the Police Supervision Agency, Florian Sulejmani, as there is no criminal offense. The decision comes a few days after the unprecedented scandal of the Court and Prosecution of Berat, which investigated and suspended from duty the head of an institution created by a special law.
The absurdity of the investigation and suspension consisted in the fact that Sulejmani had transferred several AMP employees to another position, a transfer which is also foreseen in the law or the powers of the director of this Agency. VoxNews has followed the entire case, from the registration at the Berat Prosecutor's Office, to the suspension decision by the Berat Court and then the transfer of the case to Tirana.
From the analysis of the facts with the laws and codes of the Albanian state, it resulted that the suspension and the measure was a clear violation of the entire practice by the justice of Berat, and even resembled a kind of use of the prosecution and the court for very narrow and personal interests. But, when the case was transferred to Tirana, the entire Berat bubble collapsed, so much so that the prosecution body of the capital needed only a few days to request the lifting of the suspension and then request the cessation of the investigations.
According to documents available to VoxNews, the Tirana Prosecution Office says that at the conclusion of the investigation of criminal proceedings no. 2823, initiated on April 25 against citizen Florian Sulejmani, suspected of the criminal offense of abuse of office, it resulted that the Berat Prosecution Office, with an order dated 12.10.2024, ordered the registration of criminal proceedings with number 613, for the criminal offense of "abuse of office", based on data obtained on the initiative.
"With the decision to divide the case dated April 9, 2025, the criminal proceedings against citizen Florian Sulejmani were divided, numbering it 613\1, of 2025. The Berat Prosecution Office has investigated the transfer of judicial police service officers to the Berat Local Police Directorate, assessing that this prosecution found that their transfer was made in violation of law number 25 of 2019, "on the Organization and Functioning of the Judicial Police, damaging legitimate interests," this decision states.
According to the Tirana Prosecution Office, "in the conditions where the person under investigation has followed a consolidated administrative practice, it is concluded that there is a lack of will as an element of the subjective side of the criminal offense." So it is written quite clearly that the procedure followed is only administrative and there is no criminal offense! Where did the Prosecution Office and the Court of Berat find the offense?!
The document, obtained by VoxNews, states that the case under investigation lacks the objective and subjective elements of the criminal offense of "abuse of office", as the illegality of the committed action, the consequences (damage to the interests of private persons or the state) and the intent to commit the illegal action are missing.
"For all the above, the conclusion is reached that the fact does not contain elements of a criminal offense or any other criminal offense committed by the head of the Police Supervision Agency, Florian Sulejmani. The criminal case against him for the criminal offense provided for above should be dismissed since we are facing a case provided for by article 328, the fact is not provided for by law as a criminal offense. For these reasons, I request the dismissal of the criminal proceedings," writes prosecutor Valentin Preçi.
A few days ago, VoxNews denounced that the file against Sulejmani was "a soap bubble." Our editorial staff even raised the question of whether the "Berat justice group" will be investigated by SPAK for the "AMP" file?!
"Berat's actions resemble a 'conspiracy', with many interests all around. With people who, in revenge for Sulejman's decisions, acted insidiously, suspending him in a peripheral justice system. Now that the Tirana Court has acted and decided, where will they 'hide'?! Normally, the investigation of justice people is carried out by the Special Prosecution, which can now act not for Sulejman, but for the justice circles in Berat, who act for very narrow and personal interests. But when justice turns personal or for revenge, we are dealing with a multitude of violations and criminal offenses," VoxNews would denounce.
