Fredi Beleri became the first Albanian mayor to be elected by the cell. He received the mandate from the Central Election Commission, but due to the security measures, he could not participate in the formal swearing-in ceremony as the new mayor.
Although a formal act, the lack of an oath in the new municipal council prevents it from exercising its duty, which is currently performed by Jorgo Goro, elected in 2019 as the head of Himara.
Regarding the mandate won on May 14, there are three possibilities as to how Fredi Beleri can lose it. The first is through a final court decision. In this case, it will take some time. Just today, SPAK has closed the investigations and sent the case for Judgment, a case which will be judged by the first instance of the special court.
Any decision of the first instance can be appealed to the second instance of the special court, both by Beler and by SPAK.
Thereafter, any decision of the Special Court of Appeal may be appealed to the Supreme Court. It is the latter that gives the final decision, if the special appeal court does not exercise this right earlier.
After the decision of the Supreme Court, Fredi Beleri automatically loses his mandate and the CEC must announce the new date of the early elections in Himare.
The second possibility for Beleri to lose his mandate is through dismissal by the Government. This road was chosen by the government in the case of mayors Safet Gjici, Shukri Xhelili and Lefter Alla. None of them legally challenged the government's dismissal without a final court decision.
In the case of Fredi Beleri, this is less likely to happen, given that Fredi Beleri may challenge it if there is no prior final court decision, as well as Greece's possible reaction to the case.
The third way for Beleri to lose his mandate is to sign his resignation without entering the office for a single day. Such a precedent was recorded in 2019 in the case of Valdrin Pjetri in Shkodër.
