The letter of the Prosecutor's Office of Tirana for the execution of the decision of the Court of Appeal for the deputy of the Democratic Party, Ervin Salianji, who sentenced him to 1 year in prison under the charge of false report , has been clarified .

The order for the execution of the decision has been sent to the Assembly of Albania, the Local Directorate of the Police of Tirana, the Court of Tirana and the MP Ervin Salianji.

"Enclosed we send you the order for the execution of decision No. 2900, dated 18.12.2019, of the Tirana Judicial District Court, which became final on 26.09.2024, for the convict Ervin Bujar Salianji, as well as a copy of the decision.

Take measures for the execution of the criminal decision" , the letter states.

It is written in the document that the serving of the sentence for Ervin Salianji starts from the day this decision becomes final, that is, September 26. While the sentence will be carried out in one of the regular security prisons.

The Local Police Directorate of Tirana has been entrusted with the execution of the court decision.

In Tirana, today on 27.09.2024, I, Elona Alvora, prosecutor in the Prosecutor's Office near the Court of First Instance of the General Jurisdiction of Tirana, after studying decision No. 2900, dated 18.12.2019, of the Court of the Judicial District of Tirana, which took final form on 26.09.2024 with the decision no. 3473, the case of the Court of Appeal of the General Jurisdiction of Tirana, given for the convict:

Ervin Salianji, son of Bujar and Shegë, born on 16.01.1988, born in Korçë, with higher education, with Albanian citizenship, resident in Tirana, "Asim Vokshi" street, followed at large, represented by Av. . Ledio Braho,

With the criminal decision no. 2900, dated 18.12.2019, the Court of the Judicial District of Tirana has decided, among other things:

To declare the defendant Ervin Salianji guilty of the criminal offense "False accusation". committed in cooperation and based on article 305 and 25 of the Criminal Code, he is sentenced to one (one) year of imprisonment.

The serving of the sentence for the defendant Ervin Salianji begins from the day this decision becomes final.

The serving of the sentence for the defendant Ervin Salianji will be carried out in one of the regular security prisons

This court decision was reviewed on 26.09.2024 with decision no. 3473 of the Court of Appeal of the General Jurisdiction of Tirana, where the following was decided regarding the convict:

"Enforcement of decision no. 2900, dated 18.12.2019, of the Court of the Judicial District of Tirana." The decision has been brought for execution at the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Tirana.

It turns out that the citizen Ervin Salianji is a deputy in the Assembly of the Republic of Albania, therefore a copy of the order must be communicated to the Assembly of the Republic of Albania

For the above, in support of articles 462-464 of the Penal Code, as well as Law 79/2020 on the execution of criminal decisions.

2.1 The convict must serve a sentence of 1 (one) year of imprisonment in a regular security prison.

In the conditions where the investigation and trial of the citizen Ervin Bujar Salianji was carried out in a free state, the Local Directorate of the Tirana Police is charged with the execution of this point of the court decision.
