The leader of the Democratic Party, Sali Berisha, declared today that the member of the Constitutional Court, Marsida Xhaferllari, should be removed from office, as according to him, she has violated the law by not declaring the person with whom she is cohabiting.
He made the statement during a press conference, where he said that despite the positions she has held with her vote in certain decisions of the Constitutional Court, Judge Xhaferllari should not deviate from the law.
" My positions towards this judge have been expressed and I am focusing them on this sentence. For the DP, there is no problem why the judge cohabits with the one she will cohabit with. Albania has had a law for many years and this law recognizes cohabitation and consequently all the obligations that arise from cohabitation. If this lady cohabits with a man, don't forget that she has the status of a Constitutional judge, she is hiding this and is in violation of the law. She is obliged to declare this. Once she declares it, there is no other problem. This issue came up in Parliament a few years ago and it became law", Berisha said.
According to him, "the law obliges the cohabitant, just like the wife, to declare all his activities, income, etc. The moment he deviates from the law, he should be removed from his duty. The judge has the right to want what he wants, but he must apply the law. "Who can trust a judge like this who does not apply the law and does not declare cohabitation," said Berisha.
Regarding Berisha's statements, the cohabitant of the Constitutional Court member, MP Enkelejd Alibeaj, has reacted, saying that the leader of the Democratic Party is taking revenge for the vote he cast to lift Berisha's immunity.
"Sali Berisha is not angry about the fact that I voted in the Parliamentary Mandates Committee to lift his immunity. I cannot help him with his anger, nor with the primitive revenge that he usually uses against all those who oppose him. Revenge that does not even spare the family of those who think differently from him. This is not new in Sali Berisha's political behavior. It's just that his and his family's troubles with justice cannot be the troubles of every Albanian. And as such, they cannot be the troubles of me and my family. So I invite him to pull himself together and deal with his own troubles ," said Alibeaj.
According to him , "in other words, every slander from his mouth is as worthless as everything he has said in the past 30 years about every political opponent. I would vote again in any case for the lifting of his immunity and all those who have problems with justice. I have an unwavering principled position on this, without having any grudge against him or anyone else. I cannot solve the problems that the family has with SPAK. We really did get rid of communism more than 3 decades ago, but the communist mentality is still present in politics. And unfortunately, holding the democrats and the right wing in Albania hostage."
