The name of Sali Berisha cannot be on the ballots, as the leader of the "Together We Win" coalition, because legally the deputy Sali Berisha and his political group are not in the election and part of the coalition, and as a result, the deputy Sali Berisha cannot be legally its leader.

This is the main argument of the Complaints and Sanctions Commission in the Central Election Commission in the full published decision where it rejected the request of Meta-Berisha to put the name of the former Prime Minister and forced Celibaş to put the name of Ilir Meta on the ballot.

KAS members underline that if the approved ballot paper states that next to the name of the coalition "We win together" the logo and the initial letters should be placed, then the name of the leader of the leading party of the coalition should also be placed. The Sanctions and Appeals Commission clearly states that this is a legal definition, which leaves no room for discretion.

In the disclosed decision, it is said that Berisha initially tried to register in the coalition as the chairman of the Democratic Party, but this was refused and he is not legally subject.

"Democratic Party" with Mr. Sali Berisha was the founding subject of the "Together We Win" coalition, as it results from the agreement on the creation of the coalition dated 15.03.2023. KAS also finds that with decision no. 178, dated 18.03.2023, the Commissioner has excluded from the coalition "We win together" the entity "Democratic Party" headed by Mr. Sali Berisha, de facto prohibiting him from participating in the elections", says the KAS decision.

In the decision, it is also evident that, when asked by KAS, the representative of the interested party did not provide any information about any connection/legal relationship of deputy Berisha with the coalition or with any of its participating parties, with which he could justify legally the submitted request.

“Sipas marrëveshjes së koalicionit “Bashkë Fitojmë” të datës 15.03.2023, partia udhëheqëse e tij është Partia e Lirisë. “Parti udhëheqëse e koalicionit, sipas parashikimeve të nenit 65 e vijues të Kodit Zgjedhor, është Partia e Lirisë” thuhet në këtë marrëveshje. Kjo do të thotë se palët e marrëveshjes kanë pranuar me vullnet të lirë, në momentin e krijimit të koalicionit, se për zbatimin e nenit 65 të Kodit Zgjedhor, KQZ-ja duhet të njohë dhe pranojë Partinë e Lirisë dhe kryetarin e saj, z. Ilir Metaj si përfaqësuesit zyrtarë të koalicionit. Në pajtim me jurisprudencën e Kolegjit Zgjedhor (vendimi nr. 5, datë 04.04.2021), kryetari i partisë që kërkon pika 3 e nenit 98 të Kodit Zgjedhor, nuk mund të jetë kush tjetër, përveç kryetarit të Partisë së Lirisë”, thuhet ndër të tjera në vendimin e zbardhur të KAS.
