The family of the Minister of Finance sues the permit signed by Rama to the Party School
The fight for the ownership of 38.6 thousand meters of land at the former Party School has already extended within the echelons of power. A company owned to the extent of 45 percent by the family of the finance minister has attacked as illegal in the administrative court a construction permit signed by Prime Minister Edi Rama.
In the lawsuit, AL.P.IN sh.a requests the annulment of the permit, as according to it, it was given in violation of the law without first clarifying the ownership of the land. In addition to the KKT, the company of Delina Ibrahimaj's family members also sued the State Attorney's Office, the State Cadastre Agency, the company Ferlut sh.a and the company Nova Construction. The company says that the above state institutions have violated the law, harming its interests.
KKT is an institution that functions under the Council of Ministers. Its head is the prime minister himself. Even a member from the Ministry of Finance and Economy is part of the KKT, which in most cases is the minister herself.
Power struggle
The lawsuit of the company AL.P.IN sha was submitted to the court on June 13. Its purpose is to initially immediately suspend the construction permit granted on the land subject to the conflict until the case is adjudicated. Then the cancellation of the land benefit through legalization by the company Ferlut sh.a is requested, as well as the cancellation of the construction permit.
Only two days after the filing of the lawsuit, the Court issued a summons to the parties, even setting the hearing on June 19. So everything in less than a week. A lightning speed, when at the doors of the Albanian courts citizens wait for years to get justice.
A month ago, AL.P.IN tried to block the permit in the State Cadastre Agency through a summary decision of the Supreme Court. But after the institution headed by Dallandyshe Bici rejected it, the family members of the Minister of Finance have decided to directly attack the permission signed by the Prime Minister in court.
This is the first time when a decision of an executive body signed by the prime minister is attacked as illegal by the family members of a member of the government. And the reason is money. The value of 38.6 thousand meters of land at the former party school is estimated at tens of millions of euros. So much money justifies the war within the government.
conflict
The saga of the conflict over the ownership of the land at the former Party School begins in 1993, when the then government decided to use the area of 38.6 thousand meters of state land and some objects located there as capital to form the Tirana joint society Trade Center in partnership with an Italian company. The Italian company called GGIF Investments contributed with 49.9 million ALL and took 55 percent of the shares, while the Albanian state decided as capital the facilities and the use of the land, taking 45 percent of the shares.
At that time, the law prohibited the sale of land to foreigners, so the land was given only for use. But everything would change a few years later, when the government started the privatization of enterprises with joint state capital.
In August 2005, after losing the elections, the socialist government privatized the state part in the Tirana Trade Center company for 100 million ALL to the Italian company. Within the value of 100 million ALL, the buildings and land were included. The latter was sold at the price of 2,000 lek per square meter.
There was later a criminal investigation into the matter. The prosecution concluded that the mortgage and the Ministry of Economy had committed a criminal offense by selling the land 5 times cheaper than its real value. In the investigative file, the prosecutor wrote that there is a clear criminal offense, but due to exceeding the deadlines, it has been prescribed and the case was dismissed.
Only through the reduction of the land price, a damage of 300 million ALL was caused to the state. But the real owners who were alienating the land at such a cheap price were not the Italians. A month after buying the state part of the quotas for 100 million ALL, the Italian partner sold the company Tirana Trade Center for 127 million ALL to the company AL.P.IN sha, which is owned 55 percent by Astrit Kuçani and 45 percent by the minister's family of finance.
But within the plot of 38.6 thousand square meters there were also other businesses, which had also privatized those existing facilities from the state. One of them was Ferlut sha, who had privatized the building of the former social food school in Laprakë along with 4 thousand meters of land.
Legal battle
Between Ferlut and AL.P.IN there has been a long court battle for ownership of the 4,000-meter surface. In 2013, the Court of First Instance decided to grant the right to the family members of the Minister of Finance, recognizing the ownership of the company AL.P.IN. But Ferlut appealed the decision.
A year later, the Court of Appeal decided to strip both companies of their ownership, returning to the state, not only the 4,000-meter portion that was the object of conflict between the two parties, but the entire surface of 38,600 meters. According to the Appeal, the land was illegally privatized because it was placed in the state did not place the land as capital, but only its use, so it could not be part of the sale of quotas. After this final decision, the entire surface of 38.6 thousand meters was returned to the ownership of the state.
In 2021, the Ferlut company bought the part it claimed of 4 thousand meters from the state for a price of 124 million lek through the procedure of bequeathing an unauthorized construction that it had built there during the years 96-97. And after receiving the ownership document, he decided to give it for development by signing a contract with the company Nova Construction. Last year, KKT approved the construction permit.
But the conflict was to be reopened again a few months ago, when a controversial decision of the Supreme Court decided to overturn the 2014 Appeal decision, upholding the one of the first instance. In short, the Supreme Court took the land from the state, returning it to the families of the finance minister and their partner Astrit Kuçani.
Once that land was public and through corruption it was alienated at an almost forgiven price. Then the citizens did not benefit anything. But now they face another great danger. To pay billions more to compensate the parties who claim ownership of the land thanks to the corrupt decisions of state officials./ oligarkia.al
