Suspicious papers in Mitrovica

Democratic Party of Kosovo MP, Përparim Gruda, following well-founded suspicions of tampering with the electoral process in Mitrovica, has requested that this municipality go to a rerun.

Gruda, in a press conference, said that PDK will defend until the end the will of the citizens of Mitrovica and the integrity of the elections in the Republic of Kosovo, because the vote and democracy are sacred.

"Mitrovica should go to a rerun, because there are several centers, among the largest in that city, where such irregularities have been observed. Because only through a clean process can the legitimacy of the result and the citizens' trust in democracy be guaranteed. PDK assures the citizens of Kosovo that it will follow every legal and institutional path to guarantee that the truth comes to light and that every responsible actor faces justice," emphasized the PDK deputy.

Yesterday, PDK commissioners, during the counting process, noticed irregularities such as ballots with a certain serial number, which belonged to one voting class, being found in another class, and even in other voting centers, therefore they immediately alerted the law enforcement agencies and the counting process has now been stopped.

Gruda said that the transfer of ballots did not dare to happen, assessing that the integrity of the electoral process in Mitrovica was seriously violated, because the Law on Elections, the CEC rules, as well as the Venice Commission standards for a fair and free electoral process were violated.

"The code on each ballot serves as an identifying element of the polling station and as a security mechanism to prevent the transfer of ballots from one center to another. This code is one of the fundamental elements of electoral integrity, which protects the free will of the citizen from any attempt at manipulation or misuse. Therefore, the issue of the code is not simply technical, but an essential legal and constitutional issue that is directly related to the security of the vote and the legitimacy of the election result. The concrete cases found are these: In the "Abdullah Shabani" school, three ballots belonging to other classes were found. In the "Ismail Qemali" school, a ballot belonging to the "Isa Boletini University" center was found. In a class of the "Abdullah Shabani" school, a ballot belonging to the "Migjeni" school voting center was found. In the "Migjeni" school, ballots transferred from one class to another were also found," he stated.

According to the PDK, in as many boxes as have been counted so far in Mitrovica, it has been observed that there are as many ballots carried from one class to another, or from one center to another, and all these doubts are increased when it is seen that Mitrovica is the only municipality in Kosovo where the turnout in the run-off is higher than in the first round.

"You know, in 2011, Mitrovica went to a re-run due to battery failure, as a result of the CEC's failure to guarantee a fair electoral process. This time, the CEC's failure is greater, more serious and absolutely more influential in damaging the process. All of these are clear violations of the Law on Elections and the CEC Rules, which raise well-founded suspicions of damaging the electoral process and of activating the so-called "Bulgarian train", a well-known mechanism that enables vote buying or manipulation. As you know, to put that mechanism into operation, one deviated ballot is enough. In this case, we have several ballots that were found in the wrong places", Gruda added.

PDK assesses that the electoral process in Mitrovica was accompanied by great pressure, interference in the process, use of state institutions and influence on voters, and that this was also observed on voting day, when the entire government cabinet stayed in this municipality.

"The Democratic Party of Kosovo, in addition to the denunciations made and the submission of facts to the law enforcement and justice bodies, will officially submit today the complaint to the Electoral Complaints and Appeals Panel (ECAP). This complaint will include all relevant evidence and testimony collected by our commissioners at the polling stations," said Gruda.
