Before the Turin Court of Appeal, presided over by Judge Cristina Domaneschi , 72-year-old jeweler Mario Roggero spoke for 27 minutes, reading a 26-page letter to defend himself against charges of intentional murder of two robbers, Giuseppe Mazzarino and Andrea Spinelli , as well as the injury of a third, during the robbery that took place on April 28, 2021 at his jewelry store in Grinzane Cavour.
Sentenced in the first instance to 17 years in prison, Roggero seeks to overturn the decision, calling the sentence "practically life imprisonment" for his age.
“I am 72 years old, I come from a modest and hard-working family. My wife and I became goldsmiths through hard work and sweat,” he said at the start of his speech, before Judge Domaneschi interrupted him to return to the facts of the case. Defended by lawyer Stefano Marcolini, Roggero mentioned the numerous robberies he has suffered over the years, especially the 2015 attack, when, according to him, he was beaten to death, hit with a gun butt, his nose was broken and the robbers threatened his daughter with a gun. “Since that day, we have lived in a constant state of fear. Every noise, every shadow scared us. Our lives have never been the same,” he said.
Roggero also described the minutes of the 2021 robbery, where two of the perpetrators, Spinelli and Mazzarino, entered the store armed.
"Spinelli pointed the gun at me, while Mazzarino forcibly grabbed my wife and dragged her away. The same terror seized me as in 2015. I thought: 'Again,'" he said.
According to his account, the robbers revealed their faces during the fight, which made him even more convinced that the situation could end in tragedy.
He claimed that Mazzarino shouted "I'm going to kill you," while Spinelli pointed the gun at his forehead and started counting before shooting.
At that moment, Roggero says, he remembered there was a gun in the cash register drawer.
"I don't remember seeing my wife. In those seconds of terror, the brain doesn't register everything," he declared.
The goldsmith admitted to shooting, but insisted he only did it to save himself and his family. "I shot at the car door to scare them, for fear that my wife was inside. I would never have shot at chest height." The statement caused a strong reaction from a relative of the victims, who shouted from the hall: "What about the others?"
Roggero continued: "Spinelli pointed the gun at my face. I was terrified. I shot to save my life. I had no intention of killing. I hit him unintentionally. Then I shot Mazzarino as well. As for the third robber, I thought he was armed too."
He concluded his speech with a direct message: "I acted in self-defense. If they hadn't pointed their guns, I would never have fired. I just wanted to protect my wife and family."
The Court of Appeal will decide whether the jeweler's confession will affect the change of his sentence, three years after the event that shocked Italy.
