A "mistake" of the Constitutional Court with "Raiffeisen Bank", which raises many questions

An error that at first glance may seem formal is raising many questions about the seriousness and care with which the decisions of the Constitutional Court are drafted.

In decision no. 34, dated 17 March 2026, the Constitutional Court examines a case raised by Raiffeisen Bank. At the beginning of the decision, the bank is correctly identified as “Raiffeisen Bank” sh.a. But just a few lines later, in the same document, the same bank is unexpectedly called “Raiffeisen Bank” sh.pk

This is not an insignificant mistake. In the legal and commercial world, the difference between “sh.a.” and “sh.pk” is not a technical detail at all. They are two completely different forms of companies, with different legal structures, capital, and responsibilities.

And this error does not occur in an ordinary letter, but in the very decision of the highest constitutional institution in the country.

The decision was signed by eight members of the Constitutional Court, passed through the institution's administrative and legal filters, but again no one noticed that a commercial bank was being "transformed" from a joint-stock company to a limited liability company within the same text.

The issue itself was related to the standard of reasoning of judicial decisions and the right to a fair legal process. Meanwhile, in a decision of this nature, the Constitutional Court itself produces elementary confusion over the legal identity of the requesting party.

In Albania, a bank can change its legal form "within two paragraphs" of a constitutional decision.

But what should concern us all is the fact that, if the Constitutional Court fails to even accurately maintain the legal form of a party in the process, how much trust can the public have in the care with which much more complicated issues related to the constitutional rights of citizens are analyzed?
