The Competition Authority decided today to close the preliminary investigation against the concessionaire providing the legal control service of measuring instruments, through the verification of fuel distribution instruments and liquefied gas.

According to the official announcement of the institution, at the end of the investigative procedure, the Competition Commission did not notice any signs of restriction of competition.

The Competition Commission reviewed the report of the Secretariat on the preliminary investigation against the company NOA CONTROL LLC, in the market of providing the legal control service of measuring instruments, through the verification of fuel distribution instruments and liquefied gas.

NOA CONTROL LLC, based on the Concession Contract "For the service of legal control of measuring instruments, through verification of fuel and liquefied gas distribution instruments" signed with the Ministry of Finance and Economy, has the sole and exclusive right to perform the legal control service of metering instruments, through the verification of fuel and liquefied gas distribution instruments throughout the territory of the Republic of Albania, throughout the concession period.

At the end of the investigation procedure, no signs of restriction of competition were identified by the company NOA CONTROL LLC in providing the service of verification of fuel distribution instruments and LPG, in the sense of article 9 of law no. 9121/2003.

For these reasons, the Competition Commission took Decision no. 884, dated 18.05.2022, through which it decided to close the preliminary investigation procedure and the obligation of the enterprise NOA CONTROL SHPK, as an enterprise with special rights, that during the exercise of its activity to respect the principles and rules of competition, especially provisions of article 9 of law no. 9121/2003 "On the protection of competition".

Following the meeting, the Competition Commission, pursuant to Article 70, point 2 of the law, decided to recommend to the Ministry of Finance and Economy, as follows:

a) Approval of a methodology for calculating the change of tariffs for services provided by the Concessionaire NOA Inspect LLC, these tariffs which must be reasoned and cost-oriented;

b) In any case of change of tariffs for the provision of legal control service of metering instruments, through verification of fuel and liquefied gas distribution instruments and any other service provided by the Concessionaire NOA Inspect LLC, to obtain in advance the legal assessment of Competition Authority;

c) Approval of a methodology for setting the percentage for verified measuring instruments that result in problems, implementing the recommendation given by the Exant Competition Commission with decision no. 646/2019, "On giving some recommendations regarding the Draft Concession Contract with the object" For the service of legal control of metering instruments, through the verification of fuel and liquefied gas distribution instruments ", point II / 2 / a).
