Gentian Malindi

The Special Court of Appeal has upheld the sentence of 8 years and 8 months in prison for Gentian Malindi, accused of trafficking 137 kg of cocaine from Ecuador, which was replaced with rice in the Port of Piraeus.

Malindi was accused of the criminal offenses of "narcotics trafficking" and "structured criminal group". The criminal episode for which Malindi was blamed took place in September 2019. The amount of drugs was hidden in a container sent from Ecuador with the final destination of the port of Durrës.

Its presence in the container was discovered by the authorities and during transit at the port of Piraeus in Greece, the quantity was replaced with rice. For the same traffic line, Ardian Bega and Altin Myslihaka were sentenced to 18 years in prison.

Notification:

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Florjan Kalaja (chairman), Engert Pëllumbi (member) and Igerta Hysi (member), on 25.04.2023, completed the examination of the case registered with no. 26 act, date 22.02.2023 registration, on the appeal presented by the appellant/defendant GM, against the decision no. 2, dated 10.01.2023 of the Special Court of First Instance for Corruption and Organized Crime, which decided:

1. The guilty plea of ​​the defendant GM for committing the criminal offense "Trafficking in narcotics", in cooperation in the form of a structured criminal group, "Commitment of criminal offenses by a criminal organization and a structured criminal group" provided for by Article 283/a/ 1, and in relation to articles 28/4 and 334/1 of the Criminal Code, his sentence of 13 (thirteen) years of imprisonment.

2. The guilty declaration of the defendant GM for the criminal offense "Structured criminal group", provided by article 333/a/1 of the Criminal Code and his sentence of 5 (five) years of imprisonment.

3. Based on Article 55 of the Penal Code, the defendant GM is sentenced to a single sentence of 13 (thirteen) years of imprisonment.

4. Pursuant to Article 406/1 of the Code of Criminal Procedure, the defendant GM is reduced by 1/3 (one third) of the sentence given, being finally sentenced to 8 (eight) years and 8 (eight) months of imprisonment .

5. The serving of the sentence for the unserved part shall be carried out by the defendant GM in a high security prison, in compliance with Article 16 point 1, letter "a" of Law No. 81/2020 "On the rights and treatment of prisoners and detainees".

 

In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:

 

Enforcing decision no. 2, dated 10.01.2023 of the Special Court of First Instance for Corruption and Organized Crime.
