The former candidate on the ASHM coalition's preferential list in Durrës County, Aulon Kalaja, is seeking the annulment of the Electoral College's decision, describing it as unconstitutional, because according to him, it limits the candidates' right to administrative and judicial appeal against the decisions of the CEC and KAS.
In the letter addressed to the Constitutional Court, Kalaja claims that during the vote counting process in Durrës County, falsifications and manipulations were carried out in several ballot boxes, carried out by tellers in collaboration with other candidates, with the aim of fictitiously increasing their results.
He requested from the CEC the video footage of the process, where, according to him, he identified dozens of discrepancies between the ballots and the summary tables.
Kalaja opposes the Electoral College's decision not to recount the Durrës ballot boxes.
"Only the political entity has the exclusive right to see how many votes the candidate received. I was in the Electoral College and I was not legitimized, I lost the case with a score of 4 to 1. There was a minority in my case," said Kalaja.
In a statement to the media after filing the appeal, Kalaja said that if he does not win in the Constitutional Court, the next step will be the Strasbourg Court.
"I am very convinced that I will win the case in the Constitutional Court. We have not delegated our soul to the party, but we are free to seek our votes. The next step is the Strasbourg court, but I think I will win here. Of course, I will win in Strasbourg," he said.
He requests that the Constitutional Court annul the decision and the restrictive provisions, guaranteeing equality and constitutional protection of the electoral rights of individual candidates.
