The Democratic Party Parliamentary Group has reacted after the decision of the High Judicial Council (HJC) not to review the report of the General Prosecutor's Office regarding the judge of the Special Court, Irena Gjoka, who was convicted of document forgery in 2005 by the Greek authorities.
After a 20-month verification, the General Prosecutor's Office forwarded the report to the Supreme Court on January 19, 2026, confirming the criminal conviction and its concealment in the decriminalization form, including the reassessment process and appointment to the Special Court.
According to the DP, the Supreme Court of Justice refused to consider the report and referred the matter to the High Inspector of Justice (ILD), raising strong questions about the independence and impartiality of this institution.
The Democratic Party describes this behavior as irresponsible, unconstitutional and unprecedented, which endangers public trust in the judicial system and undermines the goals of the decriminalization law and Justice Reform.
" The referral for jurisdiction to the ILD is a clear attempt to drag out this issue even further, with very serious consequences for the judiciary, citizens' rights, and public trust in the justice system."
"For the High Judicial Council, it seems normal that a judge convicted by a final criminal decision continues to be tried in the Special Court, thus undermining both the goals of the decriminalization law adopted in 2015 and the constitutional and legal package of the Justice Reform adopted in 2016 ," the official statement says.
The DP Parliamentary Group requests that the members of the Supreme Court of Kosovo include the issue on the agenda again and calls on the ILD to implement the law, demanding the immediate declaration of the end of the mandate of the convicted judge.
According to the DP, any behavior by the Supreme Court and the Constitutional Court is contrary to the Constitution and the law, and seriously violates the principles of the rule of law and the independence of the judiciary.
