Won Himara from prison, Rama can dismiss Fredi Beleri
Edi Rama and Fredi Beleri

Fredi Beleri became the first mayor to be elected from the cell.

After the votes are counted, the next step is the Central Election Commission's mandate to lead Himara for the next four years…if he gets to lead it.

There are two possibilities for Beleri to end his newly won mandate prematurely. First, if the court found him guilty of active corruption in the election with a final decision. The second possibility is that the mandate is terminated by a decision of the Council of Ministers without waiting for the decisions of the courts.

There are several precedents from the past of mayors accused and then dismissed by government decision without waiting for the court's decision. Two are the most analogous, Fatos Tushe from Lushnje and Lefter Alla from Bulqiza.

Both were charged by SPAK for tender corruption and abuse of office. The government did not wait for final decisions of justice to dismiss them. However, he used the provisions of letter a) of Article 62 of the Law on Local Self-Government to dismiss them.

Beler's case is almost identical to that of Lefter Alla. Even the newly elected mayor of Himara is accused of active corruption in the election carried out in cooperation and the court of Vlora has forwarded the file to SPAK.

The government cannot prevent him from receiving the mandate from the Central Elections Commission, but referring to the Alla e Tushe precedent, it can dismiss him as soon as he is mandated.
