The European Court of Justice annulled the decision to allow Kosovo's participation in the Body of European Regulators of Electronic Communications. Following Spain's complaint, Kosovo has been denied participation in the Body of European Regulators for Electronic Communications (BEREC).

"Since 2018, the Commission has undertaken actions for the development of the digital society and the alignment of the legislation of these countries with the legislation of the EU. One of these actions was the integration of the Western Balkans into existing regulatory bodies or expert groups, such as BEREC," the announcement of the Court's decision states.

Spain's efforts to prevent Kosovo's participation date back to 2019, immediately after the adoption of the decisions, which included Kosovo.

In March 2019, the European Commission adopted six decisions regarding the participation of national regulatory authorities (NRAs) from these countries in BEREC. In particular, he accepted the Kosovo NRA to participate in the board of regulators and BEREC working groups as well as in the board of directors of the BEREC Office.

"In June 2019, Spain filed a lawsuit before the General Court of the European Union for the annulment of this decision. This lawsuit was dismissed with the decision of September 23, 2020".

Then, Spain took its complaint for the admission of Kosovo to the second instance.

"Spain appealed against this judgment in November 2020. Spain had argued before the General Court that the Commission's decision violates the provision of the current BEREC Regulation regarding the latter's cooperation with Union bodies, third countries and international organizations, as Kosovo was not a "third country" within the meaning of this provision. The General Court stated that the concept of "third country" in the sense of this provision is not equal to that of "third country".

The Body of European Regulators for Electronic Communications (BEREC), consisting of the Council of Regulators and its Office, was established in 2009.

Developing the internal market for electronic communications networks and services and improving its functioning are the main tasks of BEREC. The latter should also ensure consistent implementation of the EU regulatory framework in this area. BEREC also acts as a forum for cooperation between national regulatory authorities (NRAs) and between NRAs and the Commission, reports Gazeta Express
