The "suspension" of the Assembly decided by the Constitutional Court

The temporary measure imposed by the Constitutional Court of Kosovo, which since September 5 has suspended all actions and decisions of the deputies of the Assembly of Kosovo, including the procedures for the formation of the Government, officially ends today.

This measure was taken following a complaint filed by the Serbian List, which contested the manner in which the constitutive session of the Assembly was conducted, particularly the fact that the Assembly was declared constituted without the election of the deputy speaker from the Serbian community. The Serbian List considered this a violation of constitutional procedures, while the Speaker of the Assembly, Dimal Basha, declared the constitution of the Assembly as complete, despite the lack of a vote for the Serbian representative in the presidency.

However, with the deadline approaching, it remains unclear what the next steps will be from local institutions.

The Speaker of the Assembly, Dimal Basha, has not given any concrete answer on how to proceed after September 30. When asked on September 16, he simply repeated the position that the Assembly is already constituted.

Meanwhile, the country's President, Vjosa Osmani, declared on September 9 that once the temporary measure expires, she will take the step of inviting the winning party of the elections to appoint a mandate to form the government.

On the other hand, the acting Prime Minister, Albin Kurti, has been very critical of this decision of the Constitutional Court. He has considered the measure as an unnecessary intervention that, according to him, has blocked all 120 members of Parliament for 25 days, forcing them to "vegetate".

However, the Constitutional Court's final decision on the case has not yet been made public, so uncertainty remains. If the Constitutional Court decides that the Assembly was not constituted in accordance with the Constitution, then new procedural steps will be required that could further delay the formation of the new government.
