Disappearance of Jan Prenga, Appeal upholds life sentence for Festim Bexhdili

Notice :

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Florjan Kalaja (chairman), Iliriana Olldashi (member) and Miliana Muça (member), today, 20.03.2023, completed the review of the registered case with no. 25 act, date 07.02.2022 registration, on the appeal submitted by the appellant/defendant Festim Bexhdili., against the decision no. 53, dated 29.09.2022 of the Special Court of First Instance for Corruption and Organized Crime which has decided:

"1. The guilty plea of ​​the defendant FB, for the commission of the criminal offense "Kidnapping or holding a person hostage" when the death was caused, committed in cooperation in the special form of the structured criminal group provided by article 109/3 - 28/4 of the Code Criminal and on the basis of this provision his sentence of life imprisonment.

The guilty plea of ​​the defendant FB, for committing the criminal offense "Unauthorized possession and production of weapons, explosive weapons and ammunition" carried out in cooperation with the special form of the structured criminal group provided for by article 278/4 - 28/4 of the Criminal Code and in relation to article 334/1 of the Criminal Code, his sentence of 7 (seven) years of imprisonment.

The guilty plea of ​​the defendant FB, for committing the criminal offense "Hiding or disposing of a corpse" committed in cooperation in the special form of a structured criminal group provided by article 303 - 28/4 of the Criminal Code and in relation to article 334/ 1 of the Penal Code, sentencing him to 8 (eight) years of imprisonment.

The guilty plea of ​​the defendant FB, for committing the criminal offense "Structured criminal group", in the form of participation, provided by article 333/a para. 2 of the Criminal Code and on the basis of this provision his punishment with 3 (three) years of imprisonment.

Based on Article 55 of the Penal Code, on the determination of punishments for the commission of certain criminal offenses, the defendant FB was sentenced to life imprisonment.

Në bazë të ligjit nr. 81/2020 “Për të drejtat dhe trajtimin e të dënuarve me burgim dhe të paraburgosurve”, nenet 15, 16 pika 1 gërma “a” i tij, këtë dënim i pandehuri F.B. ta kryejë në një institucion të sigurisë së lartë.

Deklarimin fajtor të të pandehurit O.T., për kryerjen e veprës penale “Veprime që pengojnë zbulimin e së vërtetës” kryer në bashkëpunim, e parashikuar nga neni 301 – 25 i Kodit Penal dhe në bazë të kësaj dispozite dënimin e tij me 3 (tre) vite burgim.

Në zbatim të nenit 261/1 shkronja “c” dhe 262/2 të K.Pr.Penale, shuarjen e masës së sigurimit “arrest në shtëpi” e caktuar ndaj të pandehurit O.T. me vendimin nr. 27 dt.  26.01.2021 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar për shkak se kohëzgjatja e paraburgimit është më e madhe se masa e dënimit të caktuar.

In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:

- Enforcing decision no. 53, dated 29.09.2022 of the Special Court of First Instance for Corruption and Organized Crime.
