At the conclusion of the preliminary investigations of criminal proceedings no. 244 of 2024, it resulted that the defendants and the aforementioned companies acted as a single company with clear characteristics of a structured criminal group.
These societies:
They practiced the activity in the same place
They used the same computer system or software, created for the purpose of committing the criminal offense.
They financed each other with mutual monetary resources,
Their employees moved from one company to another and carried out their activities, ostensibly to collect debts classified as bad loans, but with the clear criminal intent of illegally enriching themselves, to the detriment of a very large number of citizens. Their purpose became clear from the moment of the creation of this activity, which has lasted for more than 9 years.
As a result of the criminal activity of this structured criminal group, citizens in economic difficulties have fallen into the trap of this scheme through:
The oppression,
Unlawful use of personal data of debtors' family members
Bad faith and false facts.
Purpose of the scheme:
To illegally multiply the obligations of citizens beyond the obligation specified in the execution orders. The obligation was multiplied due to the application of high legal interest and penalties, up to 2% per day.
To collect the debt obligation by passing this obligation through illegal methods to family members or relatives of the debtors who had no connection to the initial loan. Through the restructuring of the loan, the obligation was passed on to family members who were able to pay.
To transfer assets/real estate in fictitious auctions, owned by non-bank financial institutions: Micro Credit Albania sh.a/sh.pk (MCA) and Final sh.pk
To achieve their criminal goal, employees of these companies, ordered by the leaders or organizers of this scheme, made hundreds of thousands of illegal notifications and threatening phone calls to debtors and their families. Dozens of thousands of citizens' bank accounts were blocked and remained blocked in violation of the law for several years.
Real estate was seized for minimal liability values and transferred to the ownership of the companies MCA and Final through fictitious auctions.
In addition to the illegal economic consequences, the criminal activity of this structured criminal group has also caused very serious social consequences.
Seizures:
Pursuant to Court Decision No. 4488 dated 18.07.2024 for the determination of the asset security measure, seizure has been imposed on the financial entities MCA and Final on all assets, both movable and immovable, of these companies.
In implementation of the decision dated 29.05.2024 on the seizure of bank accounts, over 420 million lek and about 1.3 million euros have been seized.
These monetary amounts were seized in personal accounts, deposits, treasury bills and securities of the defendants.
