The Court of Appeal of Tirana has stopped the trial for the Italian Gabriele Tarroni Loginoti, accused of fraud in the amount of 700 thousand euros, using arguments that contradict a previous decision of the Supreme Court.

The decision on the borders of the scandal was made on Monday of this week, by a panel of judges composed of relator Marsela Dervishi and members Valdete Hoxha and Ornela Naqellari.

Loginoti was sentenced by the first instance court in Tirana to 6 years in prison, after it was found that he had defrauded a fellow countryman, Alberto Presezzi, after a business deal for meat trade from Italy to Mongolia.

But, for the Court of Appeal, the case was outside the jurisdiction of the Albanian authorities, and it decided to suspend the trial.

Earlier, the Supreme Court had accepted that the investigation and trial against Gabriele Tarroni Loginoti was part of the Albanian jurisdiction. However, the Appellate Body has refused to consider the position of the higher court.

The registration of this criminal proceeding was ordered after the filing of the report by the Albanian citizen ML, who explained that he was acting on behalf of the victim, the Italian citizen Alberto Presezzi.

Citizen Alberto Presezzi is the administrator and owner of the company "Bruno Presezzi", based in Monza Brianza, Italy, which deals with import-export of meat all over the world.

At the end of 2018, this company entered into a business relationship with a company in Mongolia called "Eco Foods Trade", to start a project for trading meat produced in Mongolia.

In order to simplify the management of this activity that was difficult to control from Italy, the company "Bruno Presezzi" has concluded a consulting agreement in 2019, with a company established in Mongolia called "Brescia City Trade", with representative citizen Grabriele Tarroni Loginoti, Italian citizen residing in Dubai.

The agreement between "Brescia City", represented by Gabriele Tarroni, and the company "Bruno Presezzi", provided that his company would act as an intermediary in commercial relations with "Eco Foods Trade", making payments for meat purchase orders with the money the company "Bruno Presezzi" would pay to the current account at Golomt Bank Mongolia.

In September 2019, according to the agreement, the company "Bruno Presezzi" transferred to the account of "Brescia City" the monetary amounts of 1433 euros, 300,000 euros and 500,000 euros, in total 801,423 euros.

Against these payments, it turned out that the company "Brescia City" paid the company "Eco Foods Trade" only the amount of 72,008.28 euros.

As this company has not made the full payment, "Eco Foods Trade" has terminated the relationship and the product (meat) sent to customers is blocked on the way, going to waste.

Based on this fact, the company "Bruno Presezzi" has asked Gabriele Tarroni to return the unpaid amount of 729,342.72 euros, for which the owner Alberto Presezzi has spoken via video from Mongolia with Gabriele Tarroni, who had assured him that as soon as had given the transfer order for the amount of 730,000 euros in favor of the company "Bruno Presezzi".

But, despite repeated requests, Tarroni has not returned the amounts. Even, according to the complainant, Tarroni has used some non-real bank documents, in an attempt to convince that he has made efforts to repay the debt.

After many months have passed, Presezzi, feeling cheated by Tarroni, has authorized his representative in Albania to file a criminal complaint.

Court battle

Gabriele Tarroni was arrested in March 2021 in Tirana, under the suspicions that existed at that time that he had committed the criminal offense of fraud with serious consequences.

Tarroni appealed the decision of the security measure to the Court of Appeal, which upheld the decision of the first instance.

Tarroni appealed to the Supreme Court, claiming, among other things, that the Albanian authorities were not competent to examine such a case.

According to the appeal, the report in the criminal investigation process was conducted between two Italian citizens for a business deal in Mongolia. And, for this reason, Loginoti raised the claim that Albanian justice should not deal with this case, based on the provisions of the Code of Criminal Procedure for criminal offenses committed by foreign citizens.

The Supreme Court rejected all the arguments raised in the appeal by Gabriele Tarroni Loginoti.

The panel of the Supreme Court argued that the Albanian judiciary is competent to consider the case.

"From the acts verified by the courts of fact, it results that, with the registration of the company "Gala" in Albania, it was emphasized that the latter also took over the management of the activities carried out in Mongolia through the company "Brescia City Trade", the decision states. of the Supreme Court on September 14, 2021.

On the basis of this decision, as well as based on the evidence and facts provided by the Prosecutor's Office of Tirana, the court of the capital sentenced on March 2, 2022 the Italian citizen Gabriele Tarroni Loginoti to 6 years in prison, for the criminal offense of "Fraud".

The Appeal Scandal

On October 24, 2022, the Court of Appeal of Tirana announced that it had decided to overturn the decision of the first instance, dismissing the case in charge of Gabriele Tarroni and his immediate release.

In an official notice distributed by the Court of Appeal, it is stated that the trial body "found that the criminal offense was committed by an Italian citizen, in the Italian territory and the consequences came in the state of Mongolia, to the detriment of an Italian citizen".

Based on these premises, the Court of Appeal assessed that "the criminal offense was not committed in Albanian territory; the criminal offense was committed by a foreign citizen and was not committed to the detriment of a citizen or the Albanian state" and for these reasons, the Albanian criminal law is not applicable.

So, the Court of Appeal has used procedural arguments, which are completely contrary to the position of the Supreme Court, which had previously found that the Albanian authorities had jurisdiction to examine the case in charge of Gabriele Tarroni Loginoti./ Boldnews.al
