"There are 84 documents"/ Lefter Koka's lawyers: the accusations
Julian Mërtiri and Tritan Hamitaj, the lawyers of the former Minister of the Environment, Lefter Koka

Julian Mërtiri and Tritan Hamitaj, the lawyers of the former Minister of the Environment, Lefter Koka, have described as absurd the accusations leveled against their client regarding the Elbasan incinerator.

Invited to the show "Zone Zero" in Top Neës, the lawyers said that they will undo all the claims raised against Mr. Koka, with the evidence they have available.

They further added that the decisions for the construction of the Elbasan Incinerator were first requested by the Municipality, where then the Ministry of Environment requested consultation from all other relevant ministries and then the decisions were taken by the Commission, of 7 members, specialists of field, without having any influence from Mr. Koka.

Regarding the Elbasan incinerator, lawyers Julian Mërtiri and Tritan Hamitaj said that 84 documents were signed by the entire government apparatus in 10 months, as the government had declared the environmental emergency.

"We will undo all the claims raised by the Prosecution at the hearing. The charges brought against him do not stand. We want the hearing to be public.

The head requested the establishment of a Commission with 7 members. The members of the Commission appointed by the Head, the best specialists. In 2014, the government declared an environmental emergency. Initially, the Municipality of Elbasan made the request to the minister for the incineration of waste. And then the minister held 8 meetings and took the relevant decisions.

The Ministry of Environment has requested consultancy from the Ministry of Justice, the Ministry of Finance and the Ministry of Tourism, where they have all returned positive answers. Can't abuse someone who is clearly looking for counseling. It was approved by all institutions because it could not be done otherwise and finally it was approved by the Council of Ministers. It's been 10 months where 84 documents have been signed, the procedure is very regular.

The Minister cannot decide on the procedures, but it is the Commission that decides. Abuse of duty is a residual criminal offense, when no other offense is attributed to it, then we go to the general charge of "abuse of duty". But, when it is proven that there is no corruption, it makes no sense to be accused of abuse of office.

The accusations against Koka are indirect because he attributes all the accusations to the commission. 84 documents were signed, they are the work of Mr. Koka, but for these documents there are no charges from the Prosecutor's Office. The letters were signed by the entire government apparatus. It is not true that the letters passed in one day. However, when there is an environmental emergency, it means that all institutions act with an accelerated procedure, but not in those figures that have appeared in the media.

The charges raised by the Prosecutor's Office are absurd. The members of the Commission have stated that they do not know Lefter Koka and that they have stated that there was no influence from him in making decisions. There is no indication that it has to do with Lefter Koka's influence in the Commission" - explained Lefter Koka's lawyers.
