Lawyers of Durrës boycott one week, the court reacts

From today, only hearings for granting security measures will be held in the court of Durrës. All other sessions for civil or criminal cases are postponed for another term, due to the one-week boycott, decided by the Durrës Bar Association. Leaving the lawyers outside the doors of the court, until the start of the sessions, has prompted the reaction of the latter.

"The approach of the Court to leave the lawyers outside, in a very small environment and overflowing with people, outside of any hygienic conditions, in a season of both viruses and high temperatures is unacceptable and denigrating the figure of the lawyer", says Lorval Petani, head of the Durrës Bar Association.

What makes the situation more absurd is that the decision of the Durrës Court of First Instance was communicated verbally to the lawyers and not through an official letter.

"We do not have a written decision yet, to reflect the reason for leaving out, it is simply a decision of the administration and the front door of the court has been blocked. The decision was communicated to us one by one", continues Petani.

Around 500 court hearings scheduled to take place in the court are at risk of failure, as the lawyers express themselves in unison with the decision made by the House, because they feel discriminated and trampled on.

"We have an inequality between the parties, between the lawyer and the prosecutor. Do not forget that the Advocate is an institution, the figure of the advocate cannot be denigrated. The figure of the lawyer cannot be touched, because if the lawyer is touched, the state is touched", - declared the lawyer Shqiponja Meta.

"A lawyer is not a person, he is a personality. Therefore, any such action is absolutely illegal, it violates the constitutional right of the Albanian state", said lawyer Faslli Ceka.

In addition to this problem, lawyers highlight another concern, which is related to the conduct of court hearings with closed doors.

"For more than a month, the trials have been held behind closed doors and this is not reflected in any minutes. The secretary does not allow the lawyer representing the parties to enter. The order of the court does not allow the parties to enter, except for those called by the secretary", - declared the lawyer Kreshnik Poga.

Based on the case of the rape of the lawyer Sokol Mêngjesi in Tirana, a few days ago, the lawyers declare that this treatment of them by state institutions paves the way for other similar actions. If during these days, the Court will not change its stance, the Durrës Chamber of Advocates warns of the escalation of its actions.

"If there will be no reaction from the Court, we will discuss at the meeting of the Governing Council, for next week's progress, whether the actions will be escalated", declared the head of the Chamber, Lorval Petani.

The reaction of the Court of First Instance of Durrës was immediate. Through a press statement, the Court clarified that the decision to leave litigants in the premises of the lobby of the building was a consequence of the insufficiency of the existing premises in the court to cope with the addition of judges and employees of the judicial administration.

"We emphasize that this measure was taken by the Court objectively dictated by the conditions and in no case as a measure that violates access to the Court", the statement says.

At the same time, the Court announces that it will hold a meeting these days with representatives of the local Chamber of Advocacy to discuss and find an optimal solution for all parties.

The Durrës Chamber of Advocates came out today in a press conference, to clarify the reasons for the one-week boycott on their part.
